SPAK investigations, GJKKO gives prosecutors the green light to dismantle seized

SPAK has managed to secure a court order to dismantle all devices, from mobile phones to computers, that were seized from various individuals in the context of the investigation into former Deputy Prime Minister Belinda Balluku. Against the latter, SPAK has filed charges of violating equality in tenders, while the Parliament rejected a request by the Special Prosecution, which sought authorization for her arrest.

Reports indicate that a decision by GJKKO judge Erion Çela has given the green light to SPAK to dismantle equipment seized from businessmen or former subordinates of Balluk, with the aim of finding evidence that serves the investigation.

This decision by the GJKKO comes after the Constitutional Court forced SPAK to turn to the courts in cases where it needed to dismantle seized electronic or mobile devices. The Constitutional Court stated in its decision that the Prosecution can only open such devices after a court decision.

Reports indicate that the Prosecutors in the case have approached the court to allow the dismantling of all equipment that was seized from persons under investigation, such as the former head of the Albanian Road Authority, Gentian Gjyli, and the former administrator of KESH Erald Elezi, but also from all businessmen who have been summoned by SPAK to provide explanations, or as persons who may be aware of the circumstances for which the Prosecution is investigating.

Among the businessmen is Ilir Shtufi of the Nova Construction company, Arbër Abazi of the ALCO Impex company, as well as the owners of the companies 2T and Senka Shpk.
