KPK requested explanations from the prosecutor Julian Zonja, for the dismissal in court of his accusation against two employees of the Sharra landfill for the death of 17-year-old Ardit Gjoklaj in 2016 and the suspension of the case for the administrator and the Municipality of Tirana. The prosecutor insisted that the investigations were complete and the death had occurred in the landfill, but that the investigations for the administrator and the Municipality of Tirana depended on the decision of the Appeal.
On Monday morning, the Independent Qualification Commission, KPK held the second public hearing against the prosecutor of Tirana, Julian Zonja.
KPK seems to have "forgotten" to include in the administrative investigation against the subject of the revaluation, the case investigated by him of the murder of 17-year-old Ardit Gjoklaj in August 2016 in the Sharra landfill.
In the first session against Zonja on May 15, 2023, the head of the troupe Lulzim Hamitaj raised the issue as something that requires clarification, but which was not in the report made.
Hamitaj pointed out that clarification was required for the claims that the crime did not happen at the landfill. He referred to media publications, which probably refer to a statement made by the Mayor of Tirana, Erjon Veliaj, on the show "Top Story" 10 days before the session.
After the clarifications given by the subject in that session on Hamitaj's questions, the KPK body, which includes Firdes Shuli as a member and Xhensila Pine as a relator, decided to reopen the investigation against the prosecutor on this issue.
The decision-making session for Zonjë, originally scheduled for May 17, was postponed and the prosecutor was called on Monday to give additional explanations.
Ardit Gjoklaj was found murdered in the Sharra landfill at noon on August 7, 2016. According to the testimony of family members, the 17-year-old was employed at the waste sorting plant of the company "3R" shpk in Sharra. After the event, four employees of the "3R" company were arrested and its administrator Edurim Teqja was formally declared wanted, who was never arrested.
In the judicial process in April 2018, the Court of Tirana acquitted the two accused, employees of the company "3R" for the death of the 17-year-old in the Sharra landfill. For two others, the process was stopped. Meanwhile, for the administrator Edurim Teqja, the investigations have been suspended. This decision of the first instance has been appealed by the prosecutor Julian Zonja.
Referring to this situation and the fact that the teenager's death remains unsolved, Pine read in the session that in its decision the Court of First Instance in Tirana dismissed the charges brought by the prosecutor.
Pine cited the court that had criticized the investigation and pointed to the doubts raised in the decision about the crime scene and the fact that the prosecution had not carried out further investigative actions.
"The facts should have prompted the police and the prosecution to conduct thorough and specialized investigations with all methods and forms permitted by law," Pine quoted the panel as saying.
Pine said they were also seeking information on the appeal of the case and information on pending investigations into the administrator of the company "3R".
After reading the report, Hamitaj pointed out to Zonja that they had received his explanations in writing and that he could be content with them.

KPK found in this case a negative balance of 460 thousand ALL, but according to the prosecutor, it was influenced by an unintentional carelessness of not declaring the cash balance in 2010.
