
Shkelqim Mustafa, the judge who reviewed the security measures in the case of January 21, 2011, where four protesters lost their lives, stated in an interview with "Review" that the investigations into this event have never been interrupted or suspended with a final decision not to find the perpetrator.
According to him, the issue has expanded over the years, as it was impossible to handle it in a single proceeding.
" The investigation has not been discontinued for this matter, it has never been suspended for failure to identify the perpetrator with a definitive decision. The matter is also expanded in the range of people and events, because it was impossible for this matter to be closed in one proceeding, whether with the protesters, with the organizers, with the guard, with the statesmen, there have been various criminal proceedings ," said Mustafa.
The judge said that the event was filmed by cameras, including the manner of command of the Republican Guard. According to him, the investigation was carried out technically, but not completely.
" I know it in detail because I was a security measures judge. What is important is that a person summoned, what information will he give to the investigative bodies?"
January 21 was a serious matter and required accountability, but given the political developments of the time, I was lucky to be a young judge in Tirana and was given the opportunity. The data itself was technical, the investigation concerns a moment that was filmed by cameras. From the way the guard was commanded, everything has been investigated by the Prosecutor's Office.
The investigation was technical but not complete. In the law of the time, the Guard of the Republic had a duty to protect personalities and objects of special importance. The Prime Minister's Office had such an organization in connection with the Guard.
And the entire investigation should have focused on the way the regulation was implemented in the use of weapons. The use of weapons in the air at a certain period in the developments of that day was more than legal, in the air. There were technical data for which a detailed investigation should have been conducted , "said Shkëlqim Mustafa.
