
Former Prosecutor of Serious Crimes and lawyer Eugen Beci, tells what the law provides for the release of the elected mayor of Himara, Fredi Beleri, so that he can take the oath as elected in the May 14 elections.
According to him, Beler can benefit from a 48-hour release in case of a family disaster, marriage, serious illness of family members, or take an exam.
"A detainee, until he has not received a final decision, to leave the prison with a special permit, as it is called according to the law, is Article 73 which determines that this detainee, the way he leaves is with a permit institution and with the approval of the prosecutor in charge of the case. So we have a mix between prison administration and justice. If the prison administration refuses this permission, the person has the right to appeal to the court that is hearing the case. But in order to be granted permission, there are some special criteria and here is the political intervention, which is pulled like a rubber band. Leave of up to 48 hours for the detainee, e.g. in order to fulfill the oath, he must have one of his family members seriously ill with a medical certificate. Second, for important family events such as death, birth, or marriage, as well as in the cases of taking exams by the convict himself.
As it seems, the prison administration is staying very cold and says that this man has no sick person, no wedding, no death, no exam to give", said Beci for "The Unexposed".
