Former prosecutor Eugen Beci has revealed details from the tragic accident in Durrës, where two children lost their lives and another was injured.
While speaking about the way penalties for traffic violations are implemented, he said that the problem does not lie in the lack of a law, but in its implementation in practice.
"Regarding the fact that we have severe punishments, we are saying exemplary, it is true that you may not find or you can find with the fingers of one hand sentences that are over 10 years for violating traffic rules. This shows that we have very well-written laws, we have investigations that can bring out the guilty, but we do not have very high punishments ," said Beci.
He emphasized that the existing legal framework gives courts room for more severe punitive measures.
"Since 2013, the law allows you to give sentences of 10 to 15 years in prison and in certain cases even more. The sentence itself is also a preventive force, because it directly affects the deterrence of these criminal acts ," he stated.
Beci also focused on the importance of evaluating each case according to the specific circumstances.
"The sentence ranges from 5 to 15 years, but depending on the number of victims and aggravating circumstances, it can go even higher. You can give 5, 6, 7, 8, 9 or 10 years in prison, but I don't believe there are many cases in Albania with 15 or 20 years in prison for these criminal offenses," he said.
In his analysis, the former prosecutor emphasized that accidents cannot be treated in the same way, requiring differentiation based on consequences and responsibility.
"A case where a driver hits a person cannot be treated the same as a case where, for example, a bus driver causes an accident with several victims due to a violation of traffic rules. These are situations that require a more in-depth assessment and harsher penalties ," Beci told "A2 CNN".
