Aida Hajnaj will no longer be the head of the National Bureau of Investigation starting in July. After a long battle, she has been officially "fired" today, as SPAK has opened the competition for the new head of the BKH.
But what really happened?
Aida Hajnaj's term ends in July and there was a legal battle between her and SPAK. On April 22, SPAK opened the competition for the reappointment of the head of the BKH. Meanwhile, Hajnaj submitted a request to the KLP, where she requested reappointment to the position she holds, a right granted to her by law. The KLP has avoided her requests, while SPAK is working to appoint a new leader.
" The Commission composed of the Head of the Special Prosecution Office and two special prosecutors with more years of work experience as prosecutors, after an open and transparent recruitment process, recommends a candidate for Director of the National Bureau of Investigation, who is appointed by the High Prosecutorial Council. The Director is appointed for a 5-year term, with the right to reappointment once ," states Article 30.
But SPAK has held different positions. Once it announced a new leader. Then it reacted in the media by stating that the reopening of the competition is only about Ms. Hajanaj, who must apply for re-election and if she does not meet the conditions, the competition will be opened for other names. But in a letter sent to internationals, SPAK talks about appointing a new name.
Ms. Hajanj herself has refused to apply for the open competition, because according to her, the law gives her the right to have another mandate, without having to appear before a commission to determine whether or not she meets the criteria. So she refused the SPAK games.
"Pamfleti" previously reported that for more than a year, communication between the director of the National Bureau of Investigation (BKH), Aida Hajnaj, and the head of SPAK, Altin Dumani, has been limited only to the formal exchange of letters through secretaries, e-mails and official mail.
The reason for this situation is the ongoing dissatisfaction of BKH investigators with the way SPAK prosecutors handle investigative matters. SPAK prosecutors are accused by BKH of truncated charges, lack of orientation of investigations towards real criminal offenses, as well as the exclusion of certain subjects and persons from investigations due to political and clientelistic connections.
Një nga rastet kryesore që ka kulmuar konfliktin mes Hajnajt dhe Dumanit është dosja e ndërtuesit Fatmir Bektashi, i cili është nën hetim për krime ekonomiko-financiare dhe aktualisht është nën masën e lehtë të sigurisë, "Detyrim paraqitje". Hetuesit e BKH-së dorëzuan te prokurorët Arben Kraja dhe Enkeleda Millonai prova të shumta që e identifikonin Bektashin si personin kyç të një skeme të gjerë mashtrimesh dhe pastrimi parash në bashkëpunim me Jamarbër Malltezin dhe Xhimi Begenë, veçanërisht në lidhje me kullat “Partizani”. Por ai ja hodhi paq.
Tani kreun e BKH do ta zgjedhin Dumani me dy kolegë të tij dhe SPAK do kthehet në një bunker, ku të gjithë i binden kryetarit.
Shpallja e SPAK
Bazuar në ligjin nr. 95/2016 “Për organizimin dhe funksionimin e institucioneve për të luftuar korrupsionin dhe krimin e organizuar”, nenin 6, nenin 33, pikat 2 dhe 3, nenin 34, nenin 37, nenin 38, pikat 2 dhe 3, Urdhrin nr. 11794, datë 07.04.2025 “Për ngritjen e Komisionit të Përzgjedhjes së Drejtorit të Byrosë Kombëtare të Hetimit” të Drejtuesit të Prokurorisë së Posaçme kundër Korrupsionit dhe Krimit të Organizuar, Vendimin nr.5 datë 22.05.2025 të Komisionit të Përzgjedhjes së Drejtorit të Byrosë Kombëtare të Hetimit, shpall thirrjen e hapur për aplikim për pozicionin “Drejtor i Byrosë Kombëtare të Hetimit”.
Procedura e përzgjedhjes kryhet në fazat si vijon:
a) Ekzaminimi paraprak i aplikimit;
b) Vizitë mjekësore dhe test për aftësitë fizike;
c) Provim i zgjeruar me shkrim (Ese) dhe test për arsyetimin logjik;
d) Testi i poligrafit dhe intervistë në panel;
e) Verifikim figure, deklarim i pasurisë;
f) Identifikimi i kandidatit fitues, trajnimi dhe emërimi.
Për fazën e shqyrtimit të Aplikimit:
Kandidati duhet të plotësojë aplikimin on line (linku http://spak.gov.al/ëp-content/uploads/2025/05/Formulari-aplikim-Drejtor-BKH.docx ) duke dorëzuar në formë elektronike të firmosur dhe skanuar, në adresën e-mail: [email protected], si dhe fizikisht në protokollin e Prokurorisë së Posaçme:

Dokumentacionin dhe vërtetimet për plotësimin e kritereve të përzgjedhjes për pozicionin e Drejtorit të BKH-së të përcaktuara në nenin 34, pika 2 të Ligjit nr. 95/2016, si më poshtë:
a) ka përfunduar ciklin e dytë të studimeve universitare për drejtësi me diplomë të barasvlershme me “Master i shkencave”, ose arsimin e lartë policor;
b) ka eksperiencë pune si prokuror, punonjës i Policisë së Shtetit apo Policisë Gjyqësore ose hetues i Byrosë Kombëtare të Hetimit;
c) ka përvojë pune të paktën 5 vjet në çështje që kanë të bëjnë me veprat penale në fushën e korrupsionit, krimit të organizuar apo krimeve të rënda;
ç) nëse ka qenë apo është punonjës i Policisë së Shtetit, të ketë mbajtur për jo më pak se 3 vjet gradën “Komisar”, “Kryekomisar”, “Drejtues” apo “Drejtues i Parë”;
d) not be under investigation or trial for a criminal offense, not be in a state of ineligibility for public office, according to Law No. 138/2015 "On guaranteeing the integrity of persons elected, appointed or exercising public functions", as amended, and to sign the self-declaration form pursuant to that law;
dh) has not held political positions in public administration or leadership positions in political parties for at least the last ten years prior to the moment of candidacy;
e) has received the maximum assessment for his professional skills, ethics and moral integrity, if he has been subject to previous assessments, according to the legislation in force;
ë) no disciplinary measure of "dismissal from office" or any other disciplinary measure has been taken against him, which is still in force according to the legislation at the time of candidacy;
f) not to have been and not to be a collaborator, informant or agent of any intelligence service;
g) in the period 29.11.1944 – 2.7.1991 not to have been a member or candidate of the Politburo, a member of the Central Committee of the Party of Labor of Albania, a member of the Presidium of the People's Assembly, President of the Supreme Court, Prosecutor General, President of the General Investigation, member of the Council of Ministers, head of internal affairs branches, employee of the former State Security bodies, collaborator of the former State Security or favored person, member of the Central Commission for Deportations and Internments, investigator, prosecutor, judge in political processes, denouncer or witness for the prosecution in special political processes;
gj) consent to undergo a polygraph test. The information in the report prepared by the polygraph specialist is taken into consideration during the selection process.
Candidates must submit the necessary documentation by 06.06.2025. The documentation must be submitted to the Archives-Protocol Sector of the Documentation and Human Resources Directorate of the Special Prosecution Office in a sealed envelope, which is addressed to the Selection Committee for the Director of the National Bureau of Investigation.
Candidates must complete all sections of the Application Form. If a field or information is not filled in, is not readable, or is incomprehensible, the application will be rejected.
