The Constitutional Court has announced the vacancy created in this institution following the end of the mandate of member Sonila Bejtja.

In an official announcement, the Constitutional Court declares the end of the mandate of Judge Sonila Bejtja, while notifying the President of the Republic as the appointing authority to announce the vacancy.

The Constitutional Court was set in motion at the request of the President of the Republic, Bajram Begaj, for clarification on the deadline for the end of the mandate of the member of this court, Sonila Bejtja, who is an appointment of the institution of the Presidency.

"The principle of constitutional loyalty requires the necessary institutional cooperation between the Constitutional Court, the Assembly and the President of the Republic in the accurate, complete and final determination of the steps for the partial renewal of the Constitutional Court in 2025," the Presidency explained in its request.

According to the Presidency, the principle of constitutional loyalty would require the two appointing bodies, the Assembly and the President of the Republic, which are tasked with concluding the procedures for the first renewal, after the entry into force of the 2016 amendments, to respect the constitutional prerogative of the President of the Constitutional Court to set the Court in motion to declare the end of the mandate.

" However, both of these bodies would not have needed to be put into motion after 25.1.2025 to request the declaration of the end of the two mandates, if the Court itself had not linked the end of Judge Zaçaj's mandate to the need to implement the principle of partial renewal and the date of the end of her mandate to the corresponding date of the end of the mandate of the previous members.

Under these conditions, the President of the Republic, in application of the same principle of constitutional loyalty, but also with the concern to respect in all circumstances the principle of the rule of law and the supremacy of the Constitution and constitutional jurisprudence, finds it necessary to initiate this procedure before the Constitutional Court, with the aim of the Court clarifying in a complete and final manner everything that it has left unexplained and unresolved with its decision of 23.12.2024, both with regard to the manner of implementing the partial renewal mechanism in the conditions when the appointment of members was made entirely in excess of the legal deadlines, creating significant gaps, from one mandate to the next, as well as with regard to specifying the importance of the date of the end of the mandate of the predecessor judge for the initiation of the procedure for declaring the end of the mandate in all cases when the member elected late was elected with a full 9-year mandate , "the request stated.
