Gerdec Massacre, Mediu in GJKKO: SPAK does not take our evidence into account
Former Minister of Defense, Fatmir Mediu

The Special Court (GJKKO) held its next hearing against former Defense Minister Fatmir Mediu, who was named as a defendant in the Gerdec case. During the hearing, Mediu and his lawyer, Ardian Visha, opposed the prosecution's claims, mainly regarding the designation of Gerdec as a weapons dismantling zone and the issue of caliber separation.

Mediu stated that the designation of Gërdec as an area for this activity was made a week before the issuance of the ministerial order, while emphasizing that the allocation of calibers is not the competence of the Minister of Defense, but is regulated by other legal acts. He added that he will continue to oppose SPAK's claims.

"What is happening in this process is that the prosecution is holding the minister legally responsible for something that is not the minister's legal authority. This makes the situation absurd. Today we are dealing with the fact of the designation of Gërdec. It was clearly designated 1 week before the minister's order. There were some actions in relation to this contract that were made before the minister's order. And American authorities have given authorization for the shipment of dismantling machinery through a strict process of verification of the company and licenses.

The claims for permission that the minister should have given are not based anywhere in the law and the minister cannot refer to the request that may come from a private entity for the obligations that the law has. Another issue that became history, that of calibers. According to the prosecution's own experts, they have stated that there is no normative act for the administration of ammunition according to calibers. We have brought 5 orders of the Chief of General Staff before this VKM that prove that ammunition from 20 to 160 mm was treated as small caliber ammunition in the dismantling process with NATO, the USA and Great Britain. These are not taken as evidence by the prosecution and are not included in the process", said Mediu.

Mediu is accused of abuse of office, as according to SPAK, the procedures for establishing the dismantling factory in Gërdec, near a residential area, as well as those related to the administration of ammunition, were violated. The former minister has denied these accusations and has also disputed the findings of experts.

The reopening of the case against Medi came after 12 years, at the initiative of the Durda family, which lost a relative in the March 15, 2008 explosion at the premises of the former "Tank Brigade", where 26 people lost their lives and hundreds of others were injured.
