Brussels wants to make changes to the law so that those dismissed from the vetting do not work at the Magistrate....

The European Union has shaken the Magisterial School from its foundations. A few days ago, a scandal broke out in this school, as the test for new judges and prosecutors was manipulated. But in addition to that, many judges and prosecutors have been camouflaged in the Magistrate's office and remained in the vetting. 

Although they are excluded from the system, they are lecturers at the Magistrate's Office and educate the younger generation. But for internationals this is unacceptable.

In the framework of the negotiations that have started between the SP and PD on the reform laws, the opinion of the EU has been taken. In addition to many issues, Brussels wants to make changes to the law so that those dismissed from the vetting do not work at the Magistrate.

" Legislative changes should be made to strengthen the integrity of the teaching staff at the School of Magistracy, ensuring that former magistrates dismissed through vetting or who resigned before it, will not train future generations of magistrates ," states the opinion addressed to the EU to the group of deputies who are dealing with changing the laws by 3/5.

The EU does not accept the Parliament's proposal that the problems with the KLP members be resolved by the institution itself, without going through the evaluation of the Constitutional Court. Conflict of interest is cited as the reason.

" The proposals aim to limit the competence of the Constitutional Court in the disciplinary behavior of the members of the Council during the exercise of their function as a member of the Council and not when they act as judges or prosecutors. It is debatable whether this is advisable, as – although the relevant Council member may withdraw when his/her colleagues are deciding his/her case, there is still a very strong relationship between the members, which can be avoided if I leave it to the Constitutional Court to decide on such cases ", says the document published by "A2 CNN".

Also, they stopped at Altin Duman's proposal regarding the mandate of the prosecutors. According to them, at the end of the mandate, they should go to the Prosecutor's Office of Appeal.

" It is reasonable that the special prosecutors at the end of their mandate are assigned to the Appellate Prosecutor's Offices, since they cover both levels, the first instance and the Appeal. For this, it is sufficient to refer to the Law on the Status of Judges and Prosecutors ", it is further stated.
