One of the invisible "solutions" that the US Secretary of State, Antony Blinken, made during his visit to Albania, regarding the efficiency of the new justice system, was the limitation of SPAK's actions in relation to the National Bureau of Investigation.
It is true that the National Bureau of Investigation is a pre-acting administrative subordinate structure of SPAK, but legally, their duties are separated: BKH conducts the investigation, while SPAK builds, raises and represents the accusation in court, just like OPGJ with the Prosecutors.
During the 4 years of activity of SPAK and BKH, the FBI experts attached to these institutions with the role of supervisors have found that SPAK prosecutors influence the independent investigations of BKH investigators, but also interfere with clientelistic actions in the submitted reports from them.
The FBI supervisors have reported to the American State Line that created the SPAK and to the superiors in the USA, that in some files about powerful figures of politics, the power of the underworld in Albania, the prosecutors of the SPAK, have faded, minimized and have left out of the treatment, they and the defining evidence of corruption and their crimes.
In many investigative cases, it has been established that BKH investigators have submitted complete evidence for corrupt officials, connected to crime and for persons and groups of the underworld, but SPAK prosecutors have avoided the evidence.
According to the FBI supervisors, one of the problems between the investigation and the evidence that is brought to trial, is the influential orientation of the SPAK prosecutors to the BKH investigators, dictating to them which persons and evidence they should investigate; they even ask them what to report in the materials they submit, which are de facto orders to hide the evidence.
In the information provided by "Pamphlet", it is said that after the "10-minute" meeting of the American Secretary of State, Antony Blinken, with the head of SPAK, Altin Dumani, the BKH investigators have gained complete independence of action outside the influence and tutelage of the prosecutors of SPAK.
Regardless, that BKH is a subordinate structure of SPAK; immediately after Secretary Blinken's departure; each of them will perform their duty, in accordance with this "American Instruction", which is in accordance with the Annex of the Constitution for the new justice, with the law on the operation of SPAK and BKH and with the Code of Criminal Procedure.
According to the task left by Secretary Blinken, SPAK Prosecutors should not interfere with the powers and work of BKH investigators, related to investigations of individuals and evidence.
In the same way, they should not touch the evidence and remove from the files persons involved in crimes; as they did with Engjëll Agaçi, Erjon Veliaj, Ilir Beqaj, Ogerta Manastirliu, Vilma Nushi, etc.; but they must present to the court every person and evidence that the BKH investigators submit.
The fact that the High Inspector of Justice, Artur Metani, was also present at the meeting with secretary Antony Blinken, is related to the finding that many denunciations have been made in the ILD, about the clientelistic interventions of the SPAK prosecutors in the BKH investigations, but there has been no reaction from him.
