Session resumes at the GJKKO, Kryemadhi-SPAK: I have been denied the right to
The Great One

The trial on the merits against former President Ilir Meta and former MP Monika Kryemadhi is underway at the Special Court against Corruption and Organized Crime.

Kryemadhi arrived at the GJKKO premises wearing a T-shirt that read “It’s a wonderful day.” During the hearing, she challenged the evidence administered by SPAK and raised allegations of procedural violations, stating that she was not guaranteed the right to a full defense.

Upon resuming the session, Kryemadhi stated that he had been denied the right to defend himself and requested that the Special Prosecution Office make available to him the minutes of the phone examination.

Monika Kryemadhi: Your Honor, before I begin my submissions, I would like SPAK to make the minutes of the telephone examination available to me, because they are not in the file. I bear in mind that the parties are equal in the trial and we have requested this in all sessions.

This means that I have been denied the right to be equal in the process and to be protected.

I want to be given the right to defend myself according to the law, because we have not even been provided with financial expertise, which was only provided to us in August.

To have a fair process, we must have all the evidence available. We cannot be given one piece of evidence today and another tomorrow, taken out of context.

Court: Here you are in court, the preliminary process has passed. Have you signed a record of taking the acts?

Monika Kryemadhi: I received the six disks, but the relevant documents do not exist. In fact, on the third disk there are four files that cannot be opened. I have said this several times during the preliminary hearing. I am asking to know with what decision this phone was examined, on which the prosecution has filed the charges. There is no document stating which expert conducted the examination and on what date it was done. If possible, I want it to be made available to me, because the entire accusation is built on these messages and for this reason I need this document.

Prosecutor Sotir Kllapi: All the expert reports of the seized phones, not only the phone in question, are in file 62, which has been made available to the court. Meanwhile, file 63 also contains the minutes of their examination. There are two minutes: one complete and one partial.

Monika Kryemadhi: How is the phone rated?

SPAK Prosecutor: It's an iPhone. We don't know whether this phone was used by Ms. Kryemadhi or not.

Monika Kryemadhi: Why?

SPAK Prosecutor: Because the phone was found in Fatime Kryemadhi's apartment. The claim that Mrs. Kryemadhi, being a member of parliament, cannot... is not true.

Monika Kryemadhi's lawyer: Since we are dealing with a procedural act, the prosecution should have notified us. We were not given the opportunity to be present. If this procedural action was carried out, why were we not notified?

Apart from the fact that at the moment the investigations were closed, it turns out that even today, as we speak, we still have evidence that has not been made available to us.

Monika Kryemadhi: The accusation is very sexist, because for every action of mine, whether political or human, it has placed me in the position of being a servant.

It turns out that I was a collaborator with Ilir Meta on the Adrian Shatku case, while I have zero communications with Mr. Meta about Shatku. In the communications there are only messages from my son, such as: "Like this", "like this", "come on down".

Ilir Meta has zero communications about Adrian Shatku. Meanwhile, Edi Rama has given two permits for Ardian Shatku. But they have never asked Rama, they have not taken any action to say: "Come on, Mr. Rama, has Monika Kryemadhi asked you about Shatku?". So, why is Ilir Meta linked to the Shatku issue?

Why didn't the indictment include communications about the progress of mortgage cases in Pogradec and Lezha? Why didn't it call Taulant Balla as a witness, so that he could at least confront us?

That's why I say the accusation is sexist. I was an independent person. I will follow all the procedures.
