Well-known lawyer, Spartak Ngjela has commented on the political situation in the country, while he has stopped the emphasis on the event of "January 21", which must now be investigated and clarified by the Special Prosecutor's Office (SPAK), an obligation which also comes from the decision of European Court of Human Rights, received November 14, 2023.
The conclusion is clear from the Supreme Court, which gives exhaustive arguments in the complete and reasoned decision of March 12, 2024, when it accepted the request of Aleks Nika's family members, so that the state crime of 13 years ago can be fully revealed. The Supreme Court panel says it is important to take into account the position of the Strasbourg Court that the question of the possible responsibility of the Garda chain of command was not clarified by the relevant investigation, which should have focused on the nature of the orders from the chain of command. But as far as this matter is concerned, the newspaper "SOT" spoke with lawyer Ngjela, who reveals the shocking information.
Lawyer Ngjela reveals that the main server of the Prime Minister's Office that was deleted by Sali Berisha on January 21, 2011 is owned by the Americans, while he points out that the re-sent recordings have revealed that the former Prime Minister's Kalashnikov was taken and removed from his hands. Also, he expresses his conviction that the experts have facts that the DP leader gave the order to open fire on January 21, 2011.
- Lawyer Ngjela, the Supreme Court cleared the way for SPAK to investigate the January 21 file? How do you see this decision? Will there finally be justice for this terrible event?
'January 21' is a tragic event, four people were killed and nothing was done. Because Berisha was implicated with all his staff and senior DP leaders. The judiciary was corrupt, they paid something or what did they do there or they scared them. SPAK did well to bring this issue to light and let's see how the trial will go based on the court evidence that will be presented.
-Altin Dumani, head of SPAK, was the Appeal prosecutor for the case and knows the file very well. He appeared in the Appeal, he prepared a part of the report together with his colleague at that time. For how long, the prosecutors at that time in the Appeal, requested "intentional murder" for the officials of the Guard of the Republic, they definitely had a conviction referring to the evidence, materials and investigations. Do you think Sali Berisha will be punished this time?
We cannot talk about punishments, but we must have faith in SPAK. We will talk about the evidence when it comes out. Let's look at them correctly, there are a lot of interventions where four people were killed. Miserable state, four people are killed and the culprits are not punished at a time when they were all recorded.
- For January 21, exponents of the time, from the former prime minister to other leaders, have not been received, or have not given their testimonies. Should their testimonies be taken?
If the experts who dealt with that file, those people who know or have seen them, and if they confirm that they are true, this is very serious for those who committed it. But the problem is that we have to watch the trial, and I cannot speak in advance. I said what has been circulated, but whether there is court evidence or not, we will look at this in court. The important thing is that it was opened as a case. The fact that the 'January 21' case was opened, which has been a black mark for Albanian justice and for the history of Albania, now let's see how the trial in SPAK will continue.
-Sali Berisha has admitted "Live" on television that he gave the order to shoot the protesters and the former leader of the opposition, do you think this evidence alone is enough for him to be punished?
Sali Berisha was almost crazy when he said this statement: I would kill as much as I wanted. It was a moment of madness, but we prosecution professionals know that when you are faced with such an accusation you have significant deviations. The main thing is to see what evidence they have.
-They say that the server deleted by Berisha in the Prime Minister is in the hands of the American experts, do you think that there is evidence there that uncovers the murderers of January 21?
They thought that since they hid and deleted the server, they thought they were saved. But the main server of the Prime Minister's Office is in America. They all came out. I have data from experts who have told me that they came out whole, even Saliu's order. In fact, I don't know how true it is, but they say that from the new recordings sent, they say that they took Sali Berisha's Kalashnikov and took it out of his hands. But now let's see if this detail is true or not, but the experts told me this, the people who dealt with the file.
