SPAK has closed the investigations and sent the file against Benet Beci and other officials for trial, regarding the criminal offense of "Violation of equality in tenders".
In addition to Beci, the file also includes Adela Ruko, Edlira Mitrushi, Jonid Kazani, Yllka Nishku, Premtim Dauti and Rudin Gjoni.
These are tenders carried out by KESH, during the period when this institution was led by Benet Beci, who today holds the mandate of Mayor of Shkodra.
SPAK specifies that one of the main ways to secure evidence that led to the conclusion of the investigations and the clarification of the case is to analyze the evidence obtained through the use of special investigation techniques, material evidence seized during the search in the apartment of the person taken as a defendant in another proceeding, Evis Berberi.
Defendant Benet Beci, in his capacity as Administrator of the Albanian Power Corporation sh.a., in the capacity of the head of the contracting authority, in collaboration with the members of the procurement unit, defendants Jonid Kazani, Edlira Mitrushi, Yllka Nishku, as well as with the members of the bid evaluation committee, defendants Adela Ruko, Rudin Gjoni, Premtim Dauti, have predetermined and created unfair advantages and privileges for the winning company of this procurement procedure, “Consulting & Management Albania” sh.pk

The Special Prosecution Office against Corruption and Organized Crime, on 08.01.2026, has filed the request for the trial of criminal proceedings no. 196 of 2024, against the defendants: Benet Beci, Adela Ruko, Edlira Mitrushi, Jonid Kazani, Yllka Nishku, Premtim Dauti, Rudin Gjoni, accused of committing the criminal offense "Violation of equality of participants in public tenders or auctions", in collaboration, provided for by articles 258 and 25 of the Criminal Code.
The subject of this investigation is a procurement procedure conducted by the Albanian Power Corporation, with the object "Strategic Development of the Energy Sector (Research Project)", with no. REF-46463-12-18-2019, with a limit fund of 69,500,000 (sixty-nine million five hundred thousand) lek.
The investigation was launched mainly on the basis of referrals of acts by investigators from the National Bureau of Investigation (BKH).
From the administered acts it has resulted that, during the development of this procurement procedure, factual circumstances for the criminal offense of violating the equality of participants in tenders or public auctions have been identified, in relation to the illegal actions of the head of the contracting authority, members of the procurement unit and members of the bid evaluation commission. These actions have consisted in the calculation of the limit fund, the drafting of the terms of reference, the definition of criteria in the standard tender documentation, as well as in the bid evaluation phase.
Specifically, from the analysis of evidence obtained through the use of special investigative techniques, material evidence seized during the search of the apartment of the person taken as a defendant in another proceeding, citizen Evis Berberi (husband of defendant Adela Ruko), as well as from the performance of other investigative actions within the framework of this investigation, it has resulted that:

In this procurement procedure, actions have been identified in violation of Articles 1, 2, 20, 24 and 46 of Law No. 9643, dated 20.11.2006, “On Public Procurement”, as amended, as well as Articles 28 and 61 of Council of Ministers Decision No. 914, dated 29.12.2014, “On the Approval of Public Procurement Rules”.
Explanation : Every person is presumed innocent until proven guilty by a final judicial decision.
