The Special Court has revealed the reasons why the court session against the former Prime Minister, Sali Berisha, who had requested the revocation of the "house arrest" security measure against him, was postponed today.

According to GJKKO, former Prime Minister Berisha refused to sign the summons and did not even appear at today's court session.

In the meantime, it is argued that since Berisha is under house arrest, his will does not result in the right to participate in this trial or not, as long as he cannot appear in court as a free citizen.

"Sali Berisha, who is under personal security measure "house arrest", had refused to sign the summons, documented through its copy, returned to the court, signed by the specialists of the area.

Although the court found the refusal to sign, it considered the notification as completed. Despite the personal knowledge of the date and time of today's court session, in the conditions that the applicant/investigator Sali Berisha is under a coercive personal security measure "house arrest", his will does not result in the right to participate in this trial or not, as long as he cannot appear in court as a free citizen", the announcement states.

Meanwhile, the next session will take place on March 8 at 09:00.

Today on 04.03.2024, Monday, at 11:00 a.m., in the Special Court of First Instance for Corruption and Organized Crime, with a panel composed of judge Irena Gjoka, a court session was held for the examination of the criminal request registered with this court, with no. 125 of the founding regulation, dated 23.02.2024, which pertains to:

APPLICANT: Sali Berisha, son of Ram and Shiqere, dated 15.10.1944, born in Tropoja, with personal number E40701031R, represented by a special power of attorney by av. Genc Gjokutaj and av. Sokol Mêngjesi.  

OBJECT: The revocation of the personal security measure "House arrest" is requested, provided for by Article 237 of the Penal Code, determined by decision no. 112, dated 20.10.2023 of the Special Court of First Instance for Corruption and Crime Organized and continued implementation with Decision no. 117, dated 26.10.2023, of the Special Court of First Instance for Corruption and Organized Crime against the applicant, left in force with decision no. 56, dated 21.11.2023 of the Special Court of Appeal on Corruption and Organized Crime, amended by decision no. 520, dated 30.12.2023, left in force by the Special Court of Appeal for Corruption and Organized Crime

LEGAL BASIS: Articles 228, 229, 260 of the Code of Criminal Procedure.

The court, after verifying the appearance of the parties, found that the applicant/investigator Sali Berisha had not appeared in person. Referring to the respective acts of notification filed by the judicial police services, Police Station No. 1 Tirana, it turned out that the citizen under investigation Sali Berisha, who is under personal security measure "house arrest" had refused to sign the summons, documented through its copy, returned to the court, signed by the specialists of the area.

Although the court found the refusal to sign, it considered the notification as completed. Despite the personal knowledge of the date and time of today's court session, in the conditions that the applicant/investigator Sali Berisha is under a coercive personal security measure "house arrest", his will does not result in the right to participate in this trial or not, as long as he cannot appear as a free citizen in court.

Under these conditions, the Court decided to interrupt the judicial review and postpone the session to the date: 08.03.2024, Friday at 09.00.
