Defending the legality of the search and seizure of journalist Elton Qyno's phones, SPAK representatives articulated an unprecedented statement during the hearing at the Constitutional Court, which compromises not only the chronicle journalists, but also SPAK itself.

SPAK prosecutor Bledar Maksuti, appointed by Altin Dumani for the Qyno case together with Ols Dadon, stated before the trial panel that journalists, before publishing a material of a secret nature, obtain permission from SPAK whether to publish the material or not. This shows that any secret material published in the media receives the approval of SPAK. This statement portrays SPAK as the editor-in-chief of all journalists, as the filter that gives 'OK' or not for the publication of a material in the media.

The statement caught the attention of the members of the Constitutional Court. The President of the Constitutional Court, Holta Zaçaj, asked the SPAK prosecutor whether there was any legal or practical basis for journalists to obtain permission from SPAK when they wanted to publish secret information about a SPAK case.

Maksuti responded that there was no legal basis to force journalists, but insisted that the latter ask SPAK themselves about publishing information, if the information they want to publish 'disrupts' SPAK's work.

The statement before the members of the Constitutional Court also seems to put an end to the debate about the publication of wiretaps and other investigative data in some media outlets close to the Berisha family. Every investigative secret that is exposed in the media, according to this statement, has received the approval of SPAK.

This 'rule' has not been applied by journalist Elton Qyno, who was on two occasions the object of reprisals, which seem to reflect resentment and revenge from certain segments in SPAK. Perhaps this claim alone, that journalists must obtain SPAK's approval when reporting information of a secret nature, will be enough for the Constitutional Court to overturn SPAK in the Qyno case, setting a limit for other cases of retaliation as well. SPAK has the exclusivity for criminal offenses provided for in Article 75/a of the CPC and to represent the prosecution in court, but it cannot be the boss of journalists, controlling news about SPAK's activities./ Prapaskena
