'Sterilization', the Supreme Court rejects the appeal of Klodjan

The Supreme Court dismissed the appeal of Klodjan Rrjepaj, Ilir Rrapaj, Saimir Kadiu, Argjen Gjata, Genc Burazeri, Marsela Serjani, accused in the "Sterilization" case.

The accused in the sterilization case have requested a change in security measures.

Former Deputy Minister of Health, Klodian Rrjepaj and businessman Ilir Rrapaj, winner of the sterilization concession, oppose the "arrest in prison" measure.

Marsela Serjani and Saimir Kadiu, who are under house arrest, have also requested a change in the security measure. While the editor Arben Gjata and Genc Burazeri, convicted with the measure of obligation to appear, have opposed this measure, requesting the removal of this measure.

Businessman Ilir Rrapaj and former deputy minister Klodian Rjepaj were arrested in August of last year and are behind bars, as investigations continue for officials and other persons involved and in the coming days there may be other arrest warrants.

On June 23, 2023, judge Erion Bani ordered "house arrest" for Saimir Kadiu, economic director, and Marsela Serjanaj, legal director at the Ministry of Health. Doctor Arben Gjata, chief of surgery and rector of the University of Medicine, has been released by the court as an obligation to appear. The same measure has been imposed on the defendants Naile Ajazi, Genc Byrazeri and Petro Mersini, former general director of the hospital service at the Ministry of Health. While the measures were executed 2 months later, August 16-17, 2023. 

The criminal offenses recorded in the file by SPAK are falsification of documents and misuse of duties for the officials, and fraud for the businessman Rrapaj. The prosecutor is known to have sent the requests for measures to the court in June, but their implementation was done only after the location of the businessman Ilir Rrapaj, who was detained in Dhërmi where he was on vacation. The owner of the company that won the sterilization concession, Ilir Rrapaj, according to the sources of the investigation, had refused to appear to testify at SPAK.

How did the investigations begin?

For three years SPAK has started an investigation regarding the sterilization tender worth 100 million euros, which was won by Ilir Rrapaj.

The latter was an unknown businessman in business circles in Albania until 2013. Before the socialists came to power, he was the owner of a brokerage agency as well as a modest construction company based in Perugia, Italy.

A company that turned out to have only one employee in Italy, as it managed to win in Albania such a coveted tender of about 100 million dollars.

In relation to this issue, a few days ago, the former Minister of Health, Ilir Beqja, presented himself to SPAK, as the concession was granted while he was in charge of the Ministry of Health. Earlier, the former Deputy Minister of Health, Klodian Rrjepaj, was also asked.

We remind you that in June, SPAK withdrew the sterilization documents and checks in local hospitals, related to the services they perform, the quantities and payments made to the concessionaires that won the tender.

SPAK's investigations, which have lasted for two and a half years, establish that the concession was granted in violation of the law.
