Mario Përlleshaj, who is being held in custody for the murder of his peer Martin Cani, is seeking his freedom in the High Court.
Përlleshaj, through his defense attorney, has filed a recourse with the Supreme Court requesting the lifting of the measures of arrest in a designated prison by both levels of trial.
The case will be heard by Judge Ilir Panda, but a date has not yet been set.
The Court of Appeal in Tirana rejected on February 10 Përlleshi's request for the replacement of the security measure "arrest in prison". Përlleshi is in a cell after being accused of being the author of the murder of his 14-year-old peer, Martin Cani, near the "Fan Noli" school in the capital. Përlleshi is accused of committing the criminal offenses of "Intentional murder committed against a minor" and "Unlicensed production, possession, purchase or sale of cold weapons". He is being held at the juvenile prison in Kavajë.
Murder of 14-year-old
Martin Cani lost his life at noon on October 18 after being stabbed in the stomach by his peer, Mario Përlleshaj. The serious incident occurred after a conflict between two minors that escalated to the use of a knife. Mario Përlleshaj is suspected of having been in the same class as the victim, at the 9-year-old 'Fan Noli' school. The conflict between the minors reportedly started in the schoolyard, and escalated outside its premises.
The perpetrator pulled out a knife and shot 14-year-old Martin Cani. After being stabbed, Cani approached the school, walked a few meters and, after losing blood, collapsed on the sidewalk in front of the school. As a result of his injuries, Cani died in hospital. The victim's close friend, Luis Meçja, who did not study at the same school as them, was also injured in this altercation. The perpetrator himself was also injured, suffering injuries to his hand and was treated in a private hospital for several days after the serious incident.
