The Supreme Court has overturned the decision of July 12, 2023, of the Tirana Court of Appeal, which had upheld the life imprisonment sentence for Mexhit Picari, found guilty of the murder of his son-in-law, Kudret Saliaj.
With the new decision, the Supreme Court has ordered a retrial of the case at the Court of Appeals, with a different panel of judges.
The decision came after an appeal filed by lawyer Adriatik Cama, who was injured during the incident, before the Civil Court of Tirana. In his appeal, Cama requested that Dhurata Saliaj, the daughter of Mexhi Picari and the victim's ex-wife, be found guilty of complicity in the murder.
In the previous decision, the Court of Appeal had confirmed the life imprisonment sentence for Mexhit Picari, while Dhurata Saliaj was sentenced to 4 years and 6 months in prison for the criminal offense of creating the conditions for committing murder, dismissing the charge of complicity in murder.
The crime took place on June 4, 2021, in a bar near the Civil Court in Tirana. According to the investigative file, Mexhit Picari executed Kudret Saliaj just minutes before the fifth court session of the divorce process between the victim and Dhurata Saliaj was to begin.
During the shooting, lawyer Adriatik Cama, who was at the same table as Kudret Saliaj, was also injured.
According to investigations, the conflict between the parties centered on disagreements over custody of the couple's three children.
