According to the file made public by SPAK investigations, it is learned that the first procurement won by the company '5D' is the construction of a pedestrian walkway with bicycle lanes in the Dry Lake area.

2. Procurement procedure "Construction of Daias water tank 200m", with a limited fund of 5.081.302 ALL.
The contractor is Ujësjellës Kanalizime Tirana, with the holder who issued the procurement order Redi Molla, in the capacity of general director. On October 5, 2016, the KVO was established, composed of Mariglen Qato as the director of the Support Department at UKT, Manjola Bunguri and Durim Mustafa. Then "5D" was called "Igor Elektrik" shpk, which was invited to participate, as well as "Kola invest" shpk, which submitted an offer in the amount of 7,795,244 ALL. According to the contract, "Igor Elektrik" will perform 22% of the works worth 1,004,118 Lek (without VAT).
On October 24, the merger of the operators "Igor Elektrik" shpk and "Kola Invest" shpk was announced as the winner. Mariglen Qato also participated in the KVO meeting as committee chairman. According to SPAK, "Igor Elektronik" has not met all the criteria. This suits the economic cycle where it was required to have a 3-year average no smaller than the limit fund of the tender. He could not declare such a document as he had no economic activity in the last 3 years. Also, the criterion of presenting the financial balances for the years 2013, 2014, 2015 was not presented since the company itself was founded in 2016. 3. Procurement procedure "Reconstruction of the sewage collector 2x1000 on "Shyqyri Demneri" St. and reconstruction of DN-80mm water supply system".

4. Procurement procedure "Construction of water supply network, "Sulejman Pasha" street and "Ded Gjo Luli" street.

KVO disqualifies other operators and prioritizes the merger of "Igor Elektrik" and "Kola Invest" operators. "Igor Elektrik" does not meet the criteria even in this procedure. Even in two other procurements, their names appear, while SPAK says that the documentation in these procedures was observed by Mariglen Qato and had to ascertain that "Igor Elektrik" declared the same technical managers and engineers in both procedures. Also, the time of performing the works is the same period from April 10, 2017 to June 8, 2017.

5. Procurement procedure "Reconstruction or encirclement of pumping stations of regional water supply reservoirs, phase ll
Redi Molla në cilësinë e drejtorit të përgjithshëm të UKT firmos urdhërin e prokurimit dt 15.08.2018, me fond limit 37.002.844 lekë. KVO përbëhet mga Mariglen Qato, Ledia Ramo dhe Ortjon Dhami. Më 24 shtator Mariglen Qato zëvendsohet si anëtar i KVO me shtetasen Alma Quku. 4 operator marrin pjesë në garë si bashkimi i operatorëve “Rruga Ura, Asfaltim Nr.2 Elbasan” shpk, “Igor Elektrik” dhe “Delia” shpk. KVO rëndit të parën bashkimin e operatorëve “Rruga Ura, Asfaltim Nr.2 Elbasan” shpk dhe “Igor Elektrik”. Kompania e drejtorëve do të kryente punimet në një vlerë totale prej 7. 413. 455 lekë. (Me tvsh) ose 18.53% të punimeve të shumës së ofertuar. Kushtet edhe në këtë rast nuk janë zbatuar nga “Igor Elektrik” dhe kryesisht ato teknike apo mjeteve që përdoreshin njëherësh në disa kantiere ku shoqëria kishte futur “kthetrar”.
6.Procedura e prokurimit “Rikonstruksion rrjet ujësjellësi nga St. Pompimit Kroi deri teo Depo e Çokollatës.
Redi Molla firmos si titullar urdhërin e datës 16.08.2018 me fond limit 7. 922. 425 lekë, dhe KVO përbëhej nga Mariglen Qato, Ledia Ramo dhe Ortjon Dhami. Mbledhja u krye më 4 shtator 2018 dhe marrin pjesë operatorët ekonomik “Igor Elektrik” dhe “Kola Invest” si dhe “Eurondërtimi 2000” shpk. Kjo e fundit skualifikohet për mangësi në dokumentacion ndërsa bashkimi i dy të parave fiton tenderin. Kur kishte përfunduar gjithë procedura Mariglen Qato zëvendësohet më 27 shtator. Pas kësaj anëtarët e KVO kanë kryer vetëm verifikimin e dokumentacionit të depozituar në origjinal apo kopje të njësuar, pas shpalljes fitues të operatorëve. “Igor Elektrik” do kryente punimet në vlerë 4. 460. 735 lekë ose 80% të tyre, ndërsa pjesën tjetër “Kola Invest”. Dy vite nga krijimi i shoqërisë tashmë, ajo ende s’kishte arritur të siguronte mjete e kushte që të plotësonte ligjërisht kriteret, ndonëse askush nuk i mori parasysh.
7.Procedurë prokurimi “Rikonstruksion i katër linjave të transportimit Dj426 mm çelik nga Hee Lanabregas-takimin me tub Dn 700 mm çelik”.
Fondi limit 49. 106. 150 lekë, urdhëri i datës 17.08.2018 nga UKT dhe drejtori firmëtar Redi Molla. Mariglen Qato, Ledia Ramo e Ortjon Dhami anëtat të KVO. Më 24.09.2018 ku zëvendësohet Mariglen Qato. Tenderi kishte afat të implementohej për 30 ditë. “Eurondërtimi 2000” skualifikohet ndërsa “Igor” dhe “Kola” shpallen fitues. Sipas SPAK, në këtë procedurë KVO ka skualifikuar 3 operator ekonomik që në rënditje ishin me ofertë më të ulët se operatori fitues. Si dhe janë skualifikuar 4 operator të tjerë por që janë rënditur në vend të dytë deri në vendin e pestë. Igor fo krynte 40% të punimeve oae 17. 374. 987 lekë ndërsa “Kola Invest” 60% . Edhe këtu KVO ka favorizuar fituesit thot SPAK, për shkak se operatorët nuk plotësojnë kushtet teknike.
8.Prokurimi me objekt “Ndërtim rrjet kanalizimi Rruga e Durrësit”.
Data e udhrit të Redi Mollës është 12 mars 2020 me fond limit 144. 987. 028 lekë, ndërsa anëtar të KVO u zgjodhën Ledia Dhamo, Haxhire Germaj dhe Ortjon Dhami. Më 8 maj 2020 KVO zhvillon mbledhjen për vlerësimin e ofertave. 10 operator ekonomik marrin pjesë ku tashmë “Igor Elktrik” ka marrë emrin “VAS konstruksion” e cila bashkon kapitalin me “Beis” shpk dhe “Meteo” shpk, ku bashkimi këtyre operatorëve kap vlerën 113. 715. 031 me ofertën e tyre ose 0.78% e fondit limit. “VAS” do kryente sipas kontratës 18% të punimeve, 50% “Beis” dhe 32% “Meteo”. Procedura sipas spak është e rregullt dhe pa mangësi, por Redi Molla shton organi i akuzës ka firmosur fituese kompaninë në zotërim të tij.
9.Prokurim me objekt “Rikonstruksion rrjet ujësjellësi në rrugën “Aleksandër Moisiu
10.Data e urdhërit të prokurimit është 21 shtator 2020 nga UKT me fond limit në vierën 42.059,620 lekë. Lloji i procedures se prokurimit ka qenë "Procedurë e hapur". Me tënnjëjtin urdhërbjanë caktuar edhe anetaret e njesise se prokurimit dhe është nënshkruar nga drejtuesi i autoritetit kontraktor Redi Molla. KVO e ngritur përbëhet nga Ortjon Dhami, Durim Mustafa dhe Ledia Ramo. Në procedurën e prokurimit kanë marre piese 14 operatorë ekonomik përfshirë edhe bashkimi i operatorève "VAS Konstruksion sh.p.k - Senka sh.p.k". Duke vierësuar vlerën e ofertave te tjera të paraqitura rezulton se oferta e bashkimit tè operatoröve të mesiperm ka qenë ne renditje ne vendin e katert. Rezulton se KVO-ja ka s'kualifikuar operatorin ekonomik qe ne renditje ishte me oferte me te ulët se bashkimi i operatorève fitues, ndersa nje prej ofertave e ka vlerësuar si oferte anomalisht te ulët dhe e ka s'kualifikuar. KVO-ja ka renditur ne vendin e pare ofertën e bashkimit te operatoreve "VAS Konstruksion sh.p.k - Senka sh.p.k", ne vieren 38,290.119 leke.
Komisioni ka paraqitur raportin permbledhes per ecurine e procedures se prokurimit me nr. 15398/4 prol.. dt. 18.11.2020, i cili eshte miratuar nga shtetasi Elton Kacidhja ne cilésine e titullarit te autoritetit kontraktor. Autoriteti kontraktor ka shpallur formularin e njoftimit të fituesit ne daten 18.11.2020.
Ne kete procedure prokurimi shtetasi Redi Molla nëncilësine e titullarit te autoritetit kontraktor ka udhëruar kryerjen e procedurës sé prokurimit. ka caktuar njësinë e prokurimit dhe anëtaret e KVO-se, por procesi nuk eshte perfunduar prej tij pasi eshte larguar nga funksioni i mesiperm dhe miratimi i raportit permbledhës dhe lidhja e kontrates êshte realizuar nga personi që e ka zevendesuar ate ne cilésine e titullarit te autoritetit kontraktor.
11.Perveç procedurave te prokurimit tënzhvilluara nga AK shoqëria "Ujesjelles Kanalizme Tirane sha, hetimi eshte shtrirë edhe mbi procedurat e prokarimit te zhvilliara nga Ak Bashkia Tirane dhe institucionet e tjera ne varesi te saj, ne te cilat eshte shpallur fitues shoqëria "5D
42 Konstruksion sh.p.k, si pjesë e bashkimit te operatorere konkurues. Rezultojnë te dhena mbi favorizimin e operatorit ekonomik "SD Konstruksion” sh.p.k ne raport me operatoret e tjere ekonomik dhe ne raport plotesimin e kushteve dhe kritereve le kualifikimit te vendosura ne dokumentet e tenderit te seciles procedure objekt hetimi.
Konkretisht, lidhur me procedurën e prokurimit me objekt "Ndertimi i segmentit mugor ura rreth-rotutullimi Mullet deri te ura në fshatin Qeha", nga administrimi dhe shqytimi i dokumenteve të procedures se prokurimit ne fjalë, rezultone të ketë patur shkelje. Më 06.03.2019 të Bashkise Tirane eshte urdhëruar kryerja e procedures se prokurimit me objektin e mesiperm me fond limit ne vlerën 208.243.180 leke. Lloji i procedures eshte "proceduré e hapur". Me te njëjtin udher jane caktuar edhe anêtarêt e njësisë se prokurimit.
Në këtë pikë, SPAK nuk përmend emrin e titullarit kontraktues sikurse në rastet e mësiperme.
“Me urdhrin e dates 06.03.2019 te titullarit te autoritetit kontraktor ishte ngritur Komisioni i Verésimit te Ofertave te perbere nga shtetasit Taulant Tusha, Enton Punavija dhe Albano Janku. Në daten 06.03.2019 Njesia e Prokurimit ka paraqitur dokumentet e tenderit. Njoftimi i kontrates eshte bère ne datën 06.03.2019, ndêrsa afati kohor per dorêzimin e ofertave eshte parashikuar deri nê datën 08.04.2019. Ne dokumentet e tenderit eshte percaktuar se afati i punimeve do te jete 9 muaj duke nisur nga dita e nenshkrimit të kontrates. Ne daten 19.04.2019 KVO-ja ka zhvilluar mbledhjen dhe ka mbajtur proces verbalin per vleresimin e ofertave. Nga hetimet rezulton se per kete procedurë prokurimi kane marre pjesë 12 operatore ekonomike, ku perfshihet edhe bashkimi i operatoreve ekonomike "V.A.S Konstruksion shp.k & Sterkaj sh.p.k".
Rezulton se KVO-ja pasi ka vleresuar ofertat e paraqitura, janë s'koalifikuar disa operatore ekonomike per mosplotësimin e kerkesave nê dokumentet e tenderit. Ne perfundim ka renditur të paren bashkimin e operatoreve "VAS Konstruksion sh.p.k & Sterkaj sh.p.k". ne verën 158,033,075 leke, qe i korrespondon rreth 75.8 % të vlerës se fondit limit. Komisioni ka paraqitur raportin permbledhes per ecurine e procedurés se prokurimit me 0r.10709/5 prot dt.25.06.2019, i cili është miratuar nga titullari i autoritetit kontraktor. Autoriteti kontraktor ka shpallur formularin e njoftimit të fituesit ne daten 25.06.2019. Ne daten 28.06.2019 eshte lidhur kontrata e sipermarrjes midis autoritetit komaktor dhe bashkimit te operatoreve ekonomik fitues.”.
Edhe në këtë rast thotë SPAK, bashkimi i operatorëve nuk përmbush kriteret sidomos ato teknike. Sa i përket operatorit “Sterkaj” shpl, rezulton të ketë fituar disa prokurime të Bashkisë Tiranë ku njëri prej tyre është rikonstruksioni i çerdhes nr 8, me fond limit 13. 313. 313 lekë. Fituesi u njoftua me 21/3/2019 ndërsa kontra u lidh më 3/4/2019
12.Lidhur me procedurën e prokurimit me objekt "Rehabilitimi i qendrës Kinostudio", urdhër i dt.22.09.2022 të Bashkise Tirane eshte urdhër kryerja e procedures sè prokurimit me objektin e mesiperm me fond limit nè vlerën 583.046,084 49 leke, Iloji i procedures eshé procedure e hapur. Me tê njejun urdhër jane caktar edhr anétaret e njësisë se prokurimit. Me undhrin e dates 22.09.2022 tê titullarit të autoritetit konraktor, që nuk i përmendet emri në dosje, është ngritur Komisioni Vlerèsimit të Ofertave të perberè nga Taulamt Tusha, Julian Zanaj dhe Enton Punavija.
Njoftimi i dokumenteve të tenderit eshte bërë nö datên 29.09.2022, ndërsa afati kohor per dorezimin është parashikuar deri në datên 17.10.2022. Në dokumente e tenderit eshte përcaktuar se afati i punimeve do të jete 12 muaj duke nisur nga dita e lidhjes se kontrates.
Nê datën 07.11.2022 KVO-ja ka zhvilluar mbledhjen dhe ka mbajtur proces verbalin per shqyrtimin dhe vlerësimin e ofertave per proceduren e prokurimit. Kanë marrë pjesë 12 operator ekonomik mes tyre bashkimi i operatoreve ekonomik "5D Konsiraksion" sh.p.k dhe "Bami" sh.p.k.
Rezulton se KVO-ja pasi ka vlerésuar ofertat e paraqitura ka s' kualifikuar disa operatore ekonomik per mosplotesimin e kerkesave në dokumentet e tenderit. Ne perfundim ka renditur te parën ofertën e bashkimit te operatorève ekonomik "5D Konstruksion" sh.p.k dhe "Bami" Shpk në vlerën 345.099.918 leke, që i korrespondon rreth 59% te fondit limit. Edhe në këtë tender, pavarësisht opsionit që një një nga operatorët ti përmbushte kërkesat, nuk ka ndodhur, pasi 5D dhe “Bami” dyshohet të jenë zgjedhur në mënyrë preferenciale.
Gjatë hetimeve paraprake, nga kontrolli i ushtruar zyrën e shtetasit Nestor Muhametllari nga vëzhgimi i pajisjeve telefonike e kompjuterike të sekuestruara ka rezultuar se ne njesine.

Lidhur me bisedën e mesiperme nga hetimet ka rezultuar se Bashkia Tirane ka realizuar procedurën e prokurimit me reference nr.REF-67231-07-28-2020 me objekt "Rindërtimi i 8 (tete) objekteve arsimore ne Bashkine Tiranë-Ndertim i shkollës Hasan Vogli", e cila eshte zhvilluar ne datên 10.08.2020 dhe lidhur kontrata ne datën 30.09.2020.
