The Ministry of the Interior and the State Police require the opening of a special directorate, which will track and identify income, assets and any other material benefit that is generated by crime and corruption.
In a draft law distributed at the beginning of this month to all parties, including SPAK; it is required to establish the Office of Recovery of Assets generated by criminal activity, which may be subject to temporary freezing. In Article 19 of the draft law, it is proposed that the General Prosecutor's Office and SPAK, by appointing contact points, notify ZRA by letter of the orders that are sent abroad and that are related to the temporary freezing and sequestration of these assets. The confiscated assets agency should do the same.
This office is planned to be created near the general directorate of the State Police and it is proposed to have competence outside Albania, based on the bilateral agreements with the countries where the Albanian police will trace the assets of the suspects. By assigning the powers of the ZRA directorate, in addition to tracking, it is foreseen to find effective mechanisms as well as the exchange of information.
In the draft law of prosecutorial offices and courts, the control of property benefits is suggested, which includes not only monetary deposits and immovable properties, but also checks and payment orders.
The Directorate will have attached an advisory committee composed of the seized assets agency, SPAK, the National Bureau of Investigation, the financial intelligence unit and the Bank of Albania.
The Asset Recovery Office will track suspicious income and will also track the assets of politicians or legal entities connected to them until the assets are recovered, according to an authorization that gives access to the national bank account register. But the international partners that deal with the financial investigation and some well-known agencies mentioned in the draft law that was distributed to the actors on March 5 and the consultations close on March 25, 2024 are also included./TCH
