Lawyer Mark Nika's statement after the meeting with the head of SPAK raises a serious question about the January 21 file: why was a piece of evidence considered key left without re-examination for months, even after the registration of criminal proceedings?
The March 24, 2026 meeting between lawyer Mark Nika and the head of SPAK brought to the surface a fact that complicates the investigation for January 21. According to Nika's statement, the audio tape had not yet been sent for re-examination. This development raises strong suspicions of unjustified delay in a piece of evidence that is considered key to the case.
The issue of January 21st is once again at the center of debate, not for lack of evidence, not for procedural obstacles, but for the way the investigation was administered by the bodies that had the obligation to move it forward.
The meeting held on March 24, 2026 between lawyer Mark Nika, Aleks Nika's uncle, and the head of SPAK, Klodian Braho, highlighted an element that raises serious questions about the pace and seriousness of the investigation. After the meeting, Mark Nika stated that the head of SPAK had told him that the audio tape, which allegedly contains the voices of the people who gave the orders to shoot at the protesters, had not yet been sent for re-examination.
If this statement is true, then we are dealing with a procedural fact of great weight. Because it is evidence that has long been considered one of the most important elements of the file.
According to the timeline of the case, the report for January 21 was accepted after the intervention of the Supreme Court in March 2024, based on previous decisions and the request of the victims' families. The registration of the criminal proceedings at SPAK was made in July 2024. From that moment, one of the most expected investigative actions would be precisely the sending of the tape for re-examination.
But this, according to public statements made by lawyer Mark Nika, did not happen for a long time. And this is where the core of the suspicion begins. Not simply why an investigative action was not carried out, but why an investigative action that seemed elementary for the progress of the file was not carried out.
The institutional responsibility for this period falls on the then leadership of SPAK. Referring to the time when the criminal proceedings were registered and remained under the administration of the institution, the question that requires an answer is straightforward: who decided that this evidence should not be sent for re-examination and on what grounds?
The suspicions are further strengthened by another element. On July 31, 2025, in a public statement, Altin Dumani said that the investigation into the “January 21” file was progressing very well and that materials had been sent for expert examination. If in the meantime the audio tape had not yet been sent for re-examination, then there is a need for public clarification on what has actually been examined and what has been left out of the investigative actions.
This issue is further aggravated by the fact that Altin Dumani had a role in the January 21 case earlier, when he was a prosecutor in the Serious Crimes Prosecution Office. This makes the demand for transparency even more sensitive, because public opinion has the right to know whether we are dealing with procedural delays, misinterpretation of powers, or a procrastination that requires administrative and disciplinary verification.
According to the material, the file also went through a clash of competences between SPAK and the Tirana Prosecutor's Office, until the High Court considered the case to be within the competence of SPAK and ordered its registration. But even after this, according to the same allegations, the pace of the investigation remained slow and key evidence was not treated with the urgency that the file required.
We no longer have a simple political debate here. We have an issue that affects trust in the new justice system. Because if a file with four victims, of high public interest and with debatable but important evidence, drags on even after the Supreme Court order, then the problem cannot be hidden behind bureaucratic formulas.
The responsible institutions must provide clear answers. The High Prosecutorial Council and the High Inspector of Justice must verify the procedural flow of the file, the deadlines, the decision-making and the reasons why such an important investigative action was not carried out on time, if it is proven that it was not carried out.
Beyond any political interpretation, one question remains open and requires an answer with documents: why was the January 21 tape not sent for re-examination immediately after the registration of the criminal proceedings at SPAK?/ Pamphlet
E gjitha kjo ka vetëm një shpjegim. As SPAK dhe as Prokuroria e Tiranës nuk ka rregjistruar proçedim penal. Presin të vdes avokati Mark Nika. Rregjistrohet proçedim penal pa emër dhe vazhdojnë hetimet. Pa rregjistruar fare proçedim penal nuk ka si të ketë hetime paraprake dhe as kërkesë në gjykatë për shtytje të hetimeve paraprake. Dhe nuk ka si të ndodhte ndryshe. Mazhoranca (Sali Berisha) dhe opozita e atëhershme( Edi Rama) nuk mund të lejojnë të penalizojnë veten. Dhe kreu i SPAK domosdo e ka parë të 'arsyshme' të mos i luaj zaret.

O pika, pika…. 21 janari është ngjarje pothuajse e zbardhur, se e pamë me zë e figurë … Ne themi, ja ku është ujku, Spak-u thotë ku janë gjurmët…. Ajo punë more djema, do koqe të forta….për njërëz si Berisha me koqe të rënda….
