U.S. Defense Secretary Pete Hegseth said he believes the Trump administration does not need to seek authorization from Congress to go to war with Iran because a potential legal deadline is “overdue” due to the ongoing ceasefire. 
 
Under the War Powers Resolution of 1973, a presidential administration has 60 days from initial notification to Congress of the use of military force to end a military campaign or authorize continued fighting. That 60-day deadline for war in Iran will expire later this week. 
 
But Hegseth, testifying before the Senate Armed Services Committee, said the ceasefire between the U.S. and Iran that took effect on April 8 means the administration currently does not need approval despite an ongoing naval blockade. 
 
“Ultimately, I would defer to the White House and the White House counsel on this; however, we are in a ceasefire right now, which in our understanding means that the 60-day deadline stops at a ceasefire,” Hegseth said in response to a question from Virginia Democratic Senator Tim Kaine. 
 
“I don’t believe the statute would support that. The expiration of the 60-day deadline would present a really significant legal issue for the administration there ,” Kaine said afterward.
