Prosecutors do not leave Salvini, they take the "Open Arms" case to

Prosecutors are not siding with Matteo Salvini. Although in the first instance of the trial, judges decided to dismiss the charges for kidnapping migrants aboard the Open Arms ship in August 2019, the Palermo prosecutor's office has appealed to the Supreme Court.

But it seems that this action by the prosecutors has caused surprise, as it bypasses the Appeals Court judges. The prosecutors' decision, therefore, is not to examine the case on its merits, but exclusively from a legal perspective.

Such a case is called "appello per saltum" which allows the appellate process to be avoided and a decision to be made directly by the Supreme Court.

After a lengthy trial before the Palermo court, in which Salvini was accused of illegally detaining a group of migrants rescued at sea on board an NGO ship, preventing the ship from disembarking in Lampedusa, the former Interior Minister was acquitted of the charges on December 20. The reasons for the decision were presented in June.

By choosing the route of direct appeal to the Supreme Court of Cassation, the Prosecution maintains that the decision to acquit does not reject the reconstruction of the facts by the prosecution, which are therefore proven, but simply asserts, by misinterpreting international laws and conventions, that Italy was not obliged to assign a safe haven to the Spanish ship. These factors would therefore make a new appeal trial unnecessary, according to the prosecutors.
