The Court of Appeals has rejected former US President Donald Trump's claims that he is immune from criminal prosecution on charges that he attempted to overturn the outcome of the 2022 election.
The former US president does not have presidential immunity and could be prosecuted on charges of conspiring to change the outcome of the 2020 election.
The decision means he can be prosecuted for actions taken inside the White House and trying to regain control after losing the election, with a group of his supporters entering Capitol Hill on January 6, 2021.
Trump's lawyers argued that former presidents are protected from prosecution for their official actions unless they have been impeached by the House of Representatives. However, the court rejected this claim, highlighting the potential consequences of such broad immunity, the BBC reports.
The former president is expected to appeal the decision, meaning the case could eventually go to the Supreme Court, where conservatives have a 6-3 majority.
The case is one of four criminal prosecutions facing Trump, even as he remains the presumptive front-runner for the Republican presidential nomination.
The indictment, filed by Special Counsel Jack Smith, accuses Trump of pressuring state lawmakers, Justice Department officials and then-Vice President Mike Pence to prevent the certification of the election result by using false claims of voter fraud.
