SPAK has the new head of BKH in hand, politics in action to choose Duman's successor...

SPAK has shaken politics to its foundations and this year seems to be decisive for the fate of this body, in terms of its independence. Since SPAK was created, politics has intervened several times, as many prosecutors are said to have certain political support, both on the left and the right.

There has also been a fierce battle under the rug for the National Bureau of Investigation. The latter was described as the Albanian FBI, but until now has served more as a judicial police force.

Aida Hajnaj, a previously announced name, was appointed to head the organization in 2020. Hajnaj came from the police and from there moved to the BKH. The opposition accused her several times, describing her as a person appointed there by the majority.

BKH has had a significant role in SPAK's operations and investigations, but the reality is that relations between the director and SPAK officials or leaders have been cold. Aida Hajnaj had strong clashes with Arben Kraja when the latter was leading SPAK. But it is learned that the ice has also continued with Dumani, who in the latest report expressed disappointment that there are many agents who are not helping SPAK's work much. In many cases, there have also been clashes regarding files and information gathering.

But as this year marks the end of Altin Dumani's mandate, a fierce battle has begun for "control" of the BKH. Aida Hajnaj's mandate ends in July and a legal battle has begun between her and SPAK. The latter has opened the procedures for the appointment of a new head, indicating the conditions and criteria. Meanwhile, Hajnaj has submitted a request to the KLP, requesting reappointment to the position he holds, a right granted to him by law. This is where the battle has begun. The KLP has avoided her requests, while SPAK is working to appoint a new head.

" The Commission composed of the Head of the Special Prosecution Office and two special prosecutors with more years of work experience as prosecutors, after an open and transparent recruitment process, recommends a candidate for Director of the National Bureau of Investigation, who is appointed by the High Prosecutorial Council. The Director is appointed for a 5-year term, with the right to reappointment once ," states Article 30.

But SPAK has held different positions. Once it announced a new leader. Then it reacted in the media by stating that the reopening of the competition is only about Ms. Hajanaj, who must apply for re-election and if she does not meet the conditions, the competition will be opened for other names. But in a letter sent to internationals, SPAK talks about appointing a new name.

So it seems that a war has started between SPAK and politics for control of the BKH. The prosecutors want a different name. Hajnaj was part of the police and her figure has been anathematized. So the signals are that SPAK wants a different figure so that the BKH and the Prosecution function as a compact institution.

This battle comes at a time when the battle for the head of SPAK will begin shortly. Altin Dumani's mandate ends in December. Internationals have proposed changes to give him the right to run again, but so far no movement and the chances are that in December there will be strong interventions to put a person in that position who has political control.
