After the government's publication of the "Property Tax" bill, the American Chamber of Commerce has addressed a letter to the Ministry of Finance raising concerns that the proposed changes in this bill quadruple the property tax rate.
"We find that the new tariffs are very high compared to the existing ones. In the relation, there is talk of an increase in income from property tax, but the increase should come from good administration and not from the quadrupling of the tax rate", the letter is quoted.
For this reason, the American Chamber asks the finance department to review the methodology used as well as the reference prices that have been set for each area, which according to AmCham should reflect the real market value up to the unlimited tax given to the local government.
"We find that this draft law has fundamental problems in conception and writing. We notice the problems in the formulation of some definitions which are vague, evasive, without precise references and in some cases incorrect, but also in the overlap or collision of provisions with other laws", the letter explains.
Regarding the determination of the evaluation methodology, AmCham underlines that it should be done by the law and not be left entirely in the hands of the government, as it is contrary to the Constitution.
"Article 118 of the Constitution stipulates that "By-laws are issued on the basis of and for the implementation of laws by the bodies provided for in the Constitution. The law must authorize the issuing of by-laws, define the competent body, the issues that must be regulated, as well as the principles on the basis of which these acts are issued," the letter reads.
The American Chamber also lists the challenges for the success of this bill.
"The existing legal problems related to immovable properties in our country, the lack of an accurate data base for the immovable property tax as well as the definition and implementation of the effective methodology are the main challenges for the success of this draft law," the letter states. .
