Sali Berisha invented Trump's lie in the hope that he would mobilize his supporters by presenting it to them as a sign of political change...
In November, when the Court of First Instance decided to remove the security measure for Sali Berisha, there were no legal comments about the decision. The only comments were political ones, coming from the headquarters of the Democratic Party.
PD gave two explanations for the judge's decision to remove the security measure from Sali Berisha. The first, dominating all reasons and, of course, the lack of logic, was that the decision followed the victory of President Trump in the USA. This was said without a doubt, from Sali Berisha to the last DP militant. Of course, the list of candidates for deputies repeated in chorus.
The second political reason they preached was the "three resolutions" — a previously unheard-of invention, which meant that the popular parties in Europe, Asia and the USA had not opposed the DP's resolutions calling for the release of Sali Berisha. Cambodia's resolution was the strongest of the three.
Today's decision, which from a legal point of view is fully based on the decision of the Constitutional Court, rejects Berisha's claim that the appointment of the security measure "obligation to appear" had to be passed by the Assembly. Practically, this decision gives legitimacy to the first security measure, i.e. the obligation to present. At this point there is nothing to discuss.
The only thing we can discuss now is how those "three resolutions" and the victory of President Trump will affect Berisha's legal future.
If President Trump's victory affected the court's decision at the end of November, there is no reason why it should not affect the beginning of January as well, especially since we are closer to the date of the president's inauguration. And here the debate must be logical, even though this is a forbidden thing in DP circles.
I believe that the victory of President Trump can somewhat change the approach to justice reform and the relationship between politics and justice, but not in relation to individuals. The changes are expected to be in the direction of the efficiency of justice and more transparent methods used in investigative processes.
Sali Berisha invented Trump's lie in the hope of mobilizing his supporters by presenting it as a sign of political change. Today's decision has destroyed this tactic and overturned his most important political lie about his due process.
As for the "three resolutions," they may of course have been forgotten even by those who said them, but they still seriously damage the DP. This shows supporters that the court's decision was not the result of Trump or the right-wing European, Asian and American parties, but simply an independent legal decision.
This is the biggest damage that today's decision has caused to Sali Berisha. As for appearing twice a month, I don't think it's a problem for him, since it's an opportunity to hold two press conferences a month before SPAK. His acceptance of the decision shows that the first time it was not about conviction, but about the interest in taking the "house arrest" measure and creating a political movement under the window.
Now, three months of campaigning can do whatever it takes. After that, you know what it means when it loses.
