While Dritan Dajti is awaiting the final decision on whether he will be sentenced by the Supreme Court to 25 years of imprisonment or to life imprisonment, "Ora News" has learned that within a week he from Peqin prison has sent a barrage of requests to the secretariat of Court, requesting the dismissal of two judges of the Criminal College, Sandër Simoni and Medi Bici.
Dajti's request for the dismissal of judge Medi Bici was accepted on May 31, 2024 by the other member of the Supreme Court, Arbena Ahmeti, bringing Bici's removal from the trial of this criminal file.
In the court decision disclosed by Arbena Ahmeti, it is stated that: "...earlier on April 2, 2024, Medi Bici submitted to the President of the Supreme Court, Sokol Sadushi, the request to waive the consideration of this case.
However, the president of the Supreme Court, with the decision of April 17, 2024, after examining the request, has decided: "The rejection of the request of the member of the Supreme Court, Medi Bici, to waive the trial of the criminal case registered with the Supreme Court, against Dritan Dajti...".
While Subashi did not accept Medi Bic's resignation request, Dritan Dajti, on the other hand, filed a request for his exclusion from the trial of the file.
Since May 31, Dajti's request has been accepted and Medi Bici is not part of this judging panel. His replacement was made with another judge such as Artur Kalaja.
The same thing as Medi Bici, the relator of Dritan Dajti's case, judge Sandër Simoni, has done before, who on February 20, 2024, submitted to the President of the Supreme Court a request to waive the consideration of this case. after assessing that it is in the terms of Article 17, letters "c" and "ë" of the Code of Criminal Procedure.
Simon's request not to judge the "Dajti" file on February 26, 2024 was rejected by chief judge Sokol Sadushi.
Based on this situation, Dritan Dajti, through two requests on May 29 and May 30, 2024, addressed the Supreme Court, requesting the dismissal of judge Sandër Simoni from the judging panel with the argument that he is biased and that when he headed the Criminal Court of Rënda has given previous opinions and positions on the case subject to judgment.
Judge Gentian Medja, after fully examining the case of two requests made by Dritan Dajti, came to the conclusion that the request for the dismissal of judge Sandër Simoni is unsupported by law and evidence and as such it should be dismissed.
Currently, the 2019 appeal of the Prosecution of Serious Crimes is being tried in the Counseling Chamber with a panel of judges Sandër Simoni, Ilir Panda and another judge.
Serious Crimes have demanded the life imprisonment of Dritan Dajti for the charge of Murder in other qualifying circumstances" against the police officers Fatos Xhani, Kastriot Feskaj, Altin Dizdari and Ilir Duçkollar.
"Murder in other qualifying circumstances", in a dangerous way for the lives of many people, resulting in the death of the citizen Ledjon Mara and the wounding of the citizen Fatjon Shamku.
The criminal case against Dritan Dajti was announced on April 11, 2024 to be examined in the consultation room on June 4, 2024, by the Criminal College of the Supreme Court.
But today the Supreme Court was not able to issue a decision, due to the replacement of Medi Bic with another judge, Artur Kalaja.
