
Dumani has stated that the decision of the First Instance is fair by listing in the hall the murders of Laert Haxhiu.
The appeal of the Special Court against Corruption and Organized Crime has upheld the sentence of the First Degree against Laert Haxhiu, life imprisonment, found guilty of the Lushnje massacre in 2017 with two killed.
Laert Haxhiu contested the decision of the first instance to sentence him to life imprisonment.
Present in the hall during the session were only the head of SPAK, Altin Dumani and the lawyer Detar Hysi, the defendant Laert Haxhiu was absent.
At the hearing, the lawyer Detar Hysi requested the disclosure of the whole truth and the change of the decision for life imprisonment.
According to him, Laert Haxhiu is innocent and the case should be tried once again in the first instance with another judging body.
"I ask the court to evaluate our complaint objectively, making it possible to uncover the truth. We ask the court to change the decision of the GJKKO to declare Laert Haxhiu guilty. We ask for Laert Haxhiu's declaration of innocence. Or alternatively, we ask for the decision to be overturned of the first instance and sending the case to the same court with a different panel," said Haxhi's lawyer.
While Dumani has stated that the decision of the First Instance is right by listing in the hall the murders of Laert Haxhiu.
The head of SPAK emphasized that there has been a conflict between Laert Haxhi and Xjuljo Shkurt that has lasted for years.
Duman clarified how Laert Haxhi's group provided information about Xhuljo Shkurt's entry into Albania, with whom he had a long conflict.
"The decision of the first instance is a fair decision, so it should be left in force. Both the evidence of the prosecution and the evidence requested by the defense have been dealt with. As far as the implementation of the law is concerned, we think that it is a fair decision. regarding the defendant's claim and his defense for retrial, we believe that this court rightly dismissed the request. The prosecution referred to the film footage at the Gulf gas station, not the footage brought by Zamir Latif's father.There is no place for the authenticity of the evidence.
The witnesses called by the defense and the prosecution were also asked about the footage. The murder of Zamir Latif and Jurgen Hoxha had no motive, but it was done because the target was Xjuljo Shkurti, due to the conflict that Laert Haxhiu had with the latter. The defendant repeatedly in the first instance and here in Appeal heard from the defense that we are not in front of a criminal group. We clarify that the existence of a structured criminal group was proven. Between Laert Hazhi and Xjuljo Skurti there was a conflict that lasted for years.
The killing of Zamir Latif and Jurgen Hoxha had no motive, but it was done because the target was Xjuljo Shkurti, because of the conflict that Laert Haxhiu had with the latter," said Dumani.
After the claims of the parties were heard, the Appeal of GJKKO decided to uphold the life imprisonment for Laert Haxhiu.
Haxhiu was sentenced to life imprisonment by the Special Court on April 24 of this year, for what has been described as the "Lushnje Massacre", an event recorded in 2017, where two people were killed and two others were injured.
The sentence against him was given for the commission of a series of criminal offenses such as "Structured criminal group", "Commitment of criminal offenses by a criminal organization or a structured criminal group", "Murder in other qualifying circumstances", "Holding without permission and manufacturing of weapons, explosive weapons and ammunition" and "Disturbance of public peace".
