The Court of Appeal has rejected the request for release from the cell against the property guarantee made by an Italian citizen, a member of the Italian-Albanian group that had created a VAT fraud scheme, but that was busted by the police last year.
The Prosecutor's Office of Tirana has filed charges for the criminal offense of "Creation of fraudulent schemes related to value added taxes", "Forgery of stamps or forms" and "Non-payment of taxes".
For the SC citizen, the Court of First Instance of the General Jurisdiction of Tirana had set the security measure of "imprisonment"
The case on appeal was examined on the basis of the appeal made by the person under investigation with the initials S. C, who requested the annulment of the decision, the setting of the insurance measure from "prison arrest" to that of "property guarantee".
"Regarding the interest of the media, the Court of Appeal of General Jurisdiction informs the following:
At the request of the Prosecutor's Office at the Court of First Instance of the General Jurisdiction of Tirana, a trial was held regarding the verification of the conditions for the implementation of the security measure and the assignment of the personal security measure "arrest in prison" to the person under investigation with the initials S C Italian citizen, suspected of committing the criminal offense "Creation of fraudulent schemes related to value added taxes", "Forgery of stamps or forms" and "Non-payment of taxes", provided for by article 144/ae 25, 190/ 2 and 181 of the Criminal Code.
At the end of the trial, the Court of First Instance of the General Jurisdiction Tirana, with decision no. 1950 Reg. Them, dated 01.08.2024, decided:
- Continuation of the implementation of the security measure "arrest in prison" against the citizen S. C, given by the Court of First Instance of the General Jurisdiction of Gjirokastër with the decision dated 25.07.2024.
The case on appeal was examined on the basis of the appeal made by the person under investigation with the initials S. C, who requested the annulment of the decision, the setting of the security measure from "prison arrest" to that of "property guarantee".
At the end of the trial, on 19.08.2024, the Court of Appeal of General Jurisdiction, composed of Judge Ms. Miranda Andoni, decided:
-Approval of decision no. 1950 Reg. Them, date 01.08.2024 of the Court of First Instance, of the General Jurisdiction Tirana", the court announces.
