The wounding of a person by masked perpetrators in front of his family and the subsequent discovery of many illegal items, ended in the conviction of 4 people in the Court of Saranda.
With a decision of a few days ago, the Court sentenced Enrik Proda to 5 years and 4 months in prison, Armando Hako to 4 years in prison, Klajdi Muçajn to 4 months of suspended prison and Sinan Proda to 6 months of suspended prison. The Prosecutor's Office of Saranda has conducted a full investigation of the case, discovering compromising conversations through the review of mobile phone applications.
The event began on September 12, 2022, when Elidjan Kushova, 42 years old, was presented at the Saranda hospital for medical assistance. That day, he together with his wife, two children, his aunt and uncle, were sitting at a table at the bar "S..." which is located in district no. 4 Saranda, when he saw that they were coming towards him 4 or 5 people who were dressed in black, with hoods and hats and in their hands were holding things like crowbars, iron handles and one of them had a gun. He told the police that he went out in front of the children and one of the people hit him on the head with a metal handle or the barrel of a pistol.
The police reviewed the video footage of the bar where they found that "a dark-colored car with foreign license plates BI0009AB approaches the parking lot, from which four people dressed in black, hoods and hats get out, holding strong objects and one of you is holding a pistol-type weapon. These citizens approach the table where Kushova is sitting together with family members and two minor children and hit him with hard objects and leave".
After several days of investigations and video surveillance in different areas of Saranda, the police arrested Enrik Proda, 30 years old, Armando Hako, 41 years old, previously convicted of "armed robbery" and Sinan Proda, 58 years old, previously convicted for "murder". Searches of their persons and residences revealed many illegal items such as 210 grams of marijuana, 9 cartridges, 1 punch booster, 1 metal bat, 1 multifunctional vest, 2 masks, 3 pairs of gloves, 3 car license plates and 1 motorcycle license plate, 2 knives, 1 wave blocking device, 7 mobile phones, 10 Albanian and Greek SIM cards, 1 electronic scale, 2463 euros and 20,410 new lek.
As revealed by the investigations, on the day of the event, a few minutes before the event took place, a Ford Fiesta type vehicle with license plate number AB927FV, gray in color, continues on its way to the parking lot behind "Vila A...". apartment, where the "Nissan" type vehicle with foreign license plates BI0009AB, gray color, is also parked. A person identified by the police gets out of this vehicle, who approaches the "Nissan" type vehicle and opens the vehicle with the dashboard, where he enters this vehicle and from the "Ford Fiesta" type vehicle with license plate AB927FV, three people get out. others who enter the Nissan type vehicle with license plate BI0009AB. From the inspection of the footage of some private businesses, the vehicle with license plate BI0009AB was filmed until the moment it goes to the bar "S..".
This vehicle is approaching from the parking lot to the Beach Bar "S..." exit. At 9:33:19 p.m., 3 unidentified people appear who get out of a "Nissan" type vehicle with foreign license plates BI0009AB and are dressed in black clothes, with hoods and hats and are holding hard objects in their hands where one of them holds in his hands an object that appeared to be a pistol-type firearm. After a while, the fourth unidentified person appears who gets out of the "Nissan" type vehicle with foreign license plates BI0009AB, wearing black clothes with a hood and hat and holding a hard object in his hand. At 21:33:28 one of the persons appears in camera 02 who is dressed all in black hooded clothes and a hat with a white emblem and in his hand he holds an object that appears to be a pistol firearm.
After the injury of Kushova, the police followed the vehicles with cameras and managed to identify two of the perpetrators. Even the day after the event, the license plates of the "Nissan" vehicle were changed to BKE 1694. This vehicle was never found by the police. From the review of the film footage, it has emerged that the vehicle was taken by Sinan Proda, Enrik Proda's father. From the examination of the data from the TIMS system for the vehicle with license plate BKE 1694 (the license plate was changed since the first one was B10009AB), it has been proven that it entered the territory of the Republic of Albania for the last time on 27.08.2022 with a citizen driver Greek Dimitrios Karagiannidis and there is no exit after this date.
It is also proven from the inspection of the TIMS system that the citizen Dimitrios Karagiannidis was not in Albania on 15.09.2022 when it was claimed by the defendants that the owner came and took the vehicle. In his statement, Sinan Proda stated that he was going to take the car to a service center where the owner would pick it up, but on the way an unknown person appeared and told him that he was the owner and the defendant gave it to him. As it turned out and proved, the owner was not in Albania and the defendant would not give the vehicle to an unknown person who blocked his way.
Si dy nga autorët e plagosjes së Kushovës, policia arrestoi Armando Hakon dhe Enrik Prodën, ndërsa babai këtij të fundit Sinan Proda, u akuzua për “veprime që pengojnë zbulimin e së vërtetës”.
Por prokuroria nuk është mjaftuar me kaq. Këqyrja e një prej telefonave të sekuestruar, ka provuar se një prej të pandehurve ka vendosur disa shtetas, një prej të cilëve Klajdi Muçaj, që të mbanin në vëzhgim viktimën me qëllim kryerjen e sulmit ndaj tij. Nga kqyrja kanë rezultuar biseda në aplikacionin ”SIGNAL”, konkretisht me numrat +447**** të regjistruar me emrin “Lala”, me numrin 069**** të regjistruar me emrin Erisaldo Kuqo (nga të dhënat e administruara nga kompania Vodafone ky numër rezulton i regjistruar në emër të shtetasit polak Tomasz Fiuk), me numrin +79**** regjistruar me emrin “Horse”, bisedën me numrin +4474**** regjistruar me emrin “Hrow” ku ky person i sjell një automjet duke i shprehur që ta pastrojë mirë makinën që mos të ngelen gjurmë, biseda me numrin 069**** regjistruar me emrin ”Klajdi i Xikes” rezulton i regjistruar në emrin e të pandehurit Klajdi Muçaj. Nga këto biseda rezulton se këta shtetas që prej muajit gusht kanë biseda për mbajtjen nën vëzhgim, ndjekjen me qëllim kryerjen e veprës penale për sulmin ndaj viktimës Elidjan Kushova.
Në përfundim të procesit, Gjykata vendosi deklarimin fajtor të të pandehurit Enrik Proda për veprat penale ”Plagosja e lehtë me dashje”, ”Prodhim dhe shitje narkotikësh”, “Mbajtja pa leje dhe prodhimi i armëve, i armëve shpërthyese dhe i municionit”, “Prodhimi, mbajtja, blerja apo shitja pa leje e armëve të ftohta” dhe dënimin e tij me 8 vjet burgim, si dhe në aplikim të gjykimit të shkurtuar, dënimin përfundimtar me 5 vjet e 4 muaj burgim.
Gjykata vendosi deklarimin fajtor të të pandehurit Armando Hako për kryerjen e veprës penale të “Plagosja e lehtë me dashje” e kryer në bashkëpunim parashikuar, ”Prodhim dhe shitje narkotikësh”, “Prodhimi, mbajtja, blerja apo shitja pa leje e armëve të ftohta” dhe dënimin e tij me 6 vjet burgim dhe në aplikim të gjykimit të shkurtuar, dënimin përfundimtar me 4 vjet burgim.
Gjykata vendosi deklarimin fajtor të të pandehurit Klajdi Muçaj për kryerjen e veprës penale të ”Plagosja e lehtë me dashje” e kryer në bashkëpunim dhe dënimin e tij me 6 muaj burgim, në aplikim të gjykimit të shkurtuar me 4 muaj burgim, por duke pezulluar ekzekutimin e dënimit me burgim dhe vënien në provë për një periudhë prej 8 muaj me kusht që të mos kryejë vepër tjetër penale dhe të mbajë kontakte me shërbimin e provës që mbulon vendbanimin e tij.

After a period of detention, Enrik Proda and Armando Hako were placed under "house arrest" by the Court of Saranda, while Klajdi Mucaj and Sinan Proda were tried in a free state. Enrik Proda is currently in a cell after breaking the "House Arrest" measure and was caught in Qeparo in June of this year with 9 kg of marijuana, while Hako is under "House Arrest" until his sentence is finalized or not. from the Court of Appeal.
