The 1997 files are reopened/ the Special Court will retry the gang member who

23 years after the justice spoke with a final decision on the Ura Vajgurore massacre in which four police officers were killed and two others were injured, the Supreme Court returned the 1997 file to the court.

But out of nine life convicts, only one of them will be retried before the Special Anticorruption and Organized Crime Court.

As one of the members of the 1997 gang, Fran Marashi, the lifer who received this verdict in absentia, will face special judges on charges of murder of police officers, kidnapping and crimes by armed gang.

In the same file there are also the names of Musa Protoduari, Fatbardha Protoduari, ġagħa Protoduari, Edmond Protoduari, Sokol Ndreu, Gjovalin Ndreu, Gjelosh Miri and Prek Miri who were tried over two decades ago and who due to the situation of 1997 were not prosecuted in Berat, but in Tirana.

From this trial, it was proven that the three members of the Protoduari family, who were residents of Ura Vajgurore during 1997, were armed with weapons of different calibers. Due to acquaintances, a family was organized with the accused Marashi from Oblika in Shkodra, as well as several others from this area, two of whom no longer live.

The gang-like suspects started the robberies, in June they kidnapped a citizen who was saved by the intervention of a police chief. But the most serious event known as the Vajgurore Bridge massacre happened on June 17 of this year when, after an electoral rally, as the police forces were returning to Berat, they were attacked with guns and anti-tank shells in armored vehicles.

One of the witnesses of that time told the court that combustible materials were thrown on the police blind and he identified Fran Marashin among the suspects. Policemen Miltiadh Koçi, Arjan Shemuni, Asllan Selami and Ilia Bano were killed instantly in the blind and two policemen Thimi Tanku and Ylli Dhamo were injured.

Fran Marashi was handed over to Albania by Italian justice in 2006 and during this time he has been asking for a retrial for years, while he became the protagonist of a failed escape some time ago.

The Supreme Court also brings to attention a decision of the Constitutional Court in this file on the trial procedures for the Protoduari family on the right to be heard and protected.

In the Supreme Court, the state's accusation was represented by SPAK prosecutor, Doloresa Musabelliu, who will most likely represent the trial on the merits as well. / TCH
