SPAK has announced that the investigation into the state crime of January 21 will begin with taking testimonies and evidence from the family members of the murdered Aleks Nika, then with Sali Berisha, Lulzim Basha, Ilir Meta, Edi Rama, Ndrea Prend, etc., as and accepts testimony, evidence and other evidence.
Strong evidence, which SPAK must receive for January 21, are the statements that "Captain I" Agron Malaj, Head of the Special Guard Fire Unit, made in the court session on July 11, 2011.

PROSECUTOR: - What was your duty in the Guard of the Republic? What instructions did you receive on the day of the event? Tell us all your activity related to January 21, 2011.
AGRON MALAJ: - My job was Section Commander of the Special Guard Unit. On January 20, I received an order from the commander of the Special Unit for the protest.
I received the plan of measures from the chief Alfred Ahmetcenaj, for the deployment plan of the effectives of my group, and according to the order, I lined up the effectives and made the recognition of the task superficially.
Then I went to the office and made the deployment plan and took measures from the set with weapons, uniform and special tools that I needed and divided the group according to the measures pan.
JUDGE: - How many people were you in the group?
AGRON MALAJ: - I had 6 people. On the morning of January 21st, I did the briefing on the task, location and mission that was assigned. By 11:00 a.m., the officer was introduced to everything. At 11:45 we settled in the parking lot behind the prime minister's office.
I divided the effective into two groups. I placed Spartak Zilja and Meleq Zajmin on Rogner's side; while I, Gazmend Ahmetcenaj, Mark Nikolli and Sadik Çela were placed on the side of the Pyramid, where we stayed for almost 2.5 hours, while at 2:30 pm I received an order from the Unit Commander, Alfred Ahmetcenaj, to deploy the force according to the plan of measures.
After 45 minutes the crowd became more aggressive. The guard was attacked. The gate was opened by the protesters. The guard retreated, retreated, and Unit No. 2, while the crowd entered 20 meters inside the prime minister's territory.

AGRON MALAJ: - There were nearly 100 people. After these calls, fire was opened in the air, so that the crowd did not get closer to the object. I couldn't shoot because my gun jammed.

AGRON MALAJ: - We protected it.
PROSECUTOR: - If we were to talk about a hypothetical situation, do you have an obligation to act with firearms for what is outside the perimeter?
AGRON MALAJ: - No, we have no right.
PROSECUTOR: - Did you see Ndrea Prendi that day?
AGRON MALAJ: - I have not seen it.
