Murder of Nkulaj / Extradition of 4 Britons and Edmond Haxhi, Albania

In the process of extradition to the London court, of the four Britons and an Albanian wanted by Albanian justice under the suspicion that they were involved in the murder of Ardian Nikulaj in Shengjin, the parties have submitted their final comments.

In this unprecedented process, the Albanian state requesting extradition is represented by two of the most well-known British lawyers in the field of extraditions, Peter Caldwell and David Ball.

This is the final document drawn up by them provided by Top Channel, through which they argue why this court on August 27 should give the green light to the request of the Albanian state for the extradition of Edmond Haxhi, Thomas Mithan, Steven Hunt, Harry Simpson and Harriet Bridgeman.


To the court's question whether they will be extradited or face life imprisonment for blood feud, without the right to review the decision, the representatives of Albania give this answer.

"The head of the prosecution Erjon Shehaj has brought exactly this type of guarantee, when he says that they will not be punished based on the article for blood feud but for another article, the punishment of which provides for earlier release with probation. It is not only this prosecutor who has issued this guarantee. The Minister of Justice Ulsi Manja has expressed and approved this position of the Lezhë prosecution".

The defense side in this process brought as an argument the non-respect of such guarantees by the Albanian state, as was the case of the extradited from Great Britain, the double murderer Artan Muça. Representatives of the Albanian state reject this argument.

"Professor Ledi Bianku said in his testimony that he had no information about breach of guarantee in cases other than the case of Artan Muca. And so we can say that this is an isolated case, a specific consequence that has been clarified and will not be repeated in Peqin prison. This was an isolated case. There is no evidence of systematic breach of the letter of guarantee, which was also accepted by Professor Bianku".

Harriet Bridgeman's defense has raised concerns that if she is extradited she will have communication difficulties in prison.

"If Miss Bridgeman will be extradited, she will have the opportunity to stay in a new prison, that of Pojska in Pogradec, opened the first week of July. It's a modern environment and there is definitely no other so modern."

Albanian state representatives Peter Caldwell and David Ball propose to the court to accept the extradition request and send it to the signature of the secretary of state for internal work who will decide if they should be extradited based on article 87/3 of the act British extraditions 2003. /Top Channel
