Journalist Ferdinand Dervishi says that he sees the request by Ervis Martinaj's family to officially declare him missing after more than two years of absence as a way to allow family members to take legal action with his assets.
He stated that SPAK should take the matter of his disappearance into its own hands, and the moment they left it at the Kurbin Prosecutor's Office, they showed that they were not going after him.
According to him, if SPAK had taken the matter into its own hands, it would have progressed much better with this issue.
"Martinaj is a character who causes a lot of interest. He disappeared in August 2022, today we are three years later.
These are not formal enough procedures to declare someone missing. Because after being declared missing, family members can take legal and mortgage actions, because we have a person who is no longer in the family tree.
As far as I know, his father had assets and money. We have SPAK orders to freeze 35 assets. If he is declared missing, the family has the opportunity to save what they can. The assets belong to the family, according to division and percentage.
Declaring him missing does not affect the investigation into the assets, if it is proven that they are the proceeds of crime. This story of his disappearance is quite complicated.
Perhaps 100 armed people, initially entire groups, were organized to cut off his arms and then kill his uncle's son.
This is a very powerful enterprise and he was not alone, there was a group of people with weight in the criminal world. On the other hand, a more powerful group had been created that managed to defeat him, initially by cutting off all his arms.
The parents' request to declare him missing makes me understand that until recently the parents had doubts about whether he was alive or not. They may have had information, but I believe that all of this is hearsay. I believe that the parents were not given any evidence by the perpetrators and they were convinced that he might have disappeared on his own.
In the wiretapping of someone from abroad with a family member, the voice was close to that of Ervis Martinaj, but no conclusion was reached that was accurate. I think this call from abroad was made to keep this story alive.
Martinaj's disappearance occurred at a time when the Sky-Encro wiretaps were released. Vis Martinaj used another application, I don't know if these wiretaps have been found, they belong to the date of his disappearance.
