If the "Xhafaj" Commission is really going to fight corruption, change the law and allow SPAK to investigate only ministers, deputies, presidents or prime ministers...
The Allies seem to have narrowly captured the majority. Edi Rama and Fatmir Xhafaj set up a commission, which according to them, will be used to exterminate corruption once and for all. We still don't know how a commission with several deputies will fight the affairs, but while staying here, today a very interesting report came from the OSCE.
They have been monitoring justice for the last 3 years in the countries of the region, with a focus on organized crime and corruption at the highest levels.
As far as Albania is concerned, the OSCE has raised the issue that SPAK and GJKKO are overburdened and deal with low-level issues. OSCE proposes that legal changes be made and SPAK focus on corruption at the highest levels, i.e. the political one.
So this is the challenge to Rama. The "Xhafaj" Commission, if it really wants to fight corruption, should do this. Change the law and allow SPAK to investigate only ministers, deputies, presidents or prime ministers. According to the OSCE, the threshold of abusive value should be increased much more. Currently, SPAK investigates every official who has benefited over ALL 500 thousand from corruption. So an absurd number.
" The law should be changed to increase the threshold of financial values investigated by SPAK and GJKKO. During the consultations, the judges proposed that the calculation be made on the basis of the minimum wage ", the OSCE emphasizes.
According to her, another element that is tiring SPAK and GJKKO is the defamation lawsuits that MPs make against each other. According to her, this should also be removed as a competence. It also demands that the investigations and trials not be delayed, but that they be closed as soon as possible.
In addition , specialized courts handle a large number of cases of "defamation" (Article 120 of the Criminal Code) and "insult" (Article 119 of the Criminal Code) against high officials. During consultations with the project team, judges and prosecutors acknowledged an increased workload that requires additional efforts to deal with these cases ," the report states.
According to the OSCE, since SPAK also investigates the corruption of low-level officials, the statistical figures are manipulated. According to them, there should be a balance sheet only for the highest levels, and the prosecution cannot talk about great achievements, including low-level corruption in its figures.
So it seems that this is the challenge for the government. If Rama and Xhafaj really want to attack corruption, let the prosecutors investigate politics and that is enough. / Pamphlet
