The Committee for Legal Affairs followed the second point of the agenda with the hearing of the head of the People's Advocate, Erinda Ballanca.

While he asked for support with increased staff and budget for 2025, the discussions came out of the agenda, moving into debates between the parties, up to politics, where the object was the immigrants' agreement with Italy.

The People's Advocate asked for an additional commissioner for the issue of immigration, while MP Gazment Bardhi asked if according to the courts the agreement is now unenforceable, if this commissioner was needed anymore and if the institution had the right to supervise or monitor the camp.

Ballanca said that they had the right to supervise the issue of human rights, coordinating with the Italian side.

"We asked to increase the capacities of the national mechanism for the prevention of torture, even with the additional tasks we have for the protection of immigrants and the tasks we will have for the increased protection we must have for the Albania-Italy agreement, we would also need another commissioner , from 4 to 5", she said.

While the PD MP, Gazment Bardhi, said that the agreement is now unenforceable.

"You asked for a deputy commissioner to oversee the implementation of the Albania-Italy agreement? Does the Ombudsman have jurisdiction to oversee this agreement? As long as the camp is outside the jurisdiction of Albania, according to the decision of the Constitutional Court... Even this decision is a bit contradictory, because on the other hand it says that Albania must keep an eye on the camp. There are decisions of the Italian courts that make the agreement unenforceable. If the same situation continues and there will be no immigrants..., will there still be a need for the supplement you asked for?", he said.

But Ballanca explained that the Ombudsman was looking for an additional person on staff for immigration issues as a whole and not just for the deal.

"We are looking for an extra person for the immigration issue as a whole, but apart from that, the Ombudsman believes that there are obligations to oversee human rights within the camp. The Constitutional Court has said that as far as human rights and conventional rights are concerned, these immigrants will have reinforced protection, also from Albania and Italy. We have held several meetings with the Italian counterparts, in order to have a joint activity and to coordinate the work for the protection and guarantee of fundamental rights. We got in touch and are clarifying our position. The fact that we think of going with joint teams, everyone will have the opportunity to present their findings regarding human rights", explained Ballanca.
