The DP Parliamentary Group accuses the Supreme Court of Kosovo of violating the Constitution in the case of GJKKO member Irena Gjoka, who was convicted in Greece and did not declare the conviction on the decriminalization form.

The DP Parliamentary Group's position states that the High Judicial Council refused to consider the report of the General Prosecutor's Office, forwarding it to the High Inspector of Justice for competence. "This irresponsible and unprecedented behavior of the High Judicial Council, in violation of the Constitution and organic laws that charge it with making decisions on cases of incompatibility and ineligibility of judges, raises strong questions about the independence and impartiality of the governing body of the judicial power," the statement says.

According to the statement, referring the case to the ILD for jurisdiction is a clear attempt to drag out this issue even further, with very serious consequences for the judiciary, citizens' rights, and public trust in the justice system.

"For the High Judicial Council, it seems normal that a judge convicted with a final criminal decision continues the trial in the Special Court, thus undermining both the goals of the decriminalization law adopted in 2015, as well as the constitutional and legal package of the Justice Reform adopted in 2016," emphasizes the Democratic Parliamentary Group.

Reaction from the DP Parliamentary Group

After a verification that lasted 20 months, on January 19, 2026, the General Prosecutor's Office forwarded to the High Judicial Council the results of the verification for the judge of the Special Court Irena Gjoka, confirming the criminal conviction for falsification of documents by the Greek authorities in 2005 and the concealment of this conviction in the decriminalization form, including the process of transitional reassessment and appointment to the Special Court.

11 days later, in violation of its constitutional and legal obligations, the High Judicial Council refused to review the report of the General Prosecutor's Office, forwarding it to the High Inspector of Justice for competence. This irresponsible and unprecedented behavior of the High Judicial Council, in violation of the Constitution and the organic laws that charge it with making decisions on cases of incompatibility and ineligibility of judges, raises strong questions about the independence and impartiality of the governing body of the judiciary.

The referral to the ILD is a clear attempt to drag out this issue even further, with very serious consequences for the judiciary, citizens' rights and public trust in the justice system. For the High Judicial Council, it seems normal for a judge convicted by a final criminal decision to continue the trial in the Special Court, thus undermining both the goals of the decriminalization law adopted in 2015 and the constitutional and legal package of the Justice Reform adopted in 2016.

The Parliamentary Group of the Democratic Party strongly condemns the irresponsible, unconstitutional and illegal behavior of the High Judicial Council and we ask the honest members of this Council to request the inclusion of this issue on the agenda again, in order to guarantee the integrity, independence and impartiality of the governing body of the judicial system. We also call on the High Inspector of Justice to implement the law and immediately request from the High Judicial Council the declaration of the end of the mandate for the convicted judge.

Any different behavior by the Supreme Court and the Supreme Court of Justice is contrary to the Constitution and the law, and seriously violates the principles of the rule of law, the independence of the judiciary, and public trust in the justice system.
