On Tuesday, December 26, former Prime Minister Sali Berisha will have another battle with the Special Court, which set it as the date when it will consider SPAK's request to tighten the security measure against him.
Sali Berisha attacked the judge Irena Gjoka, a day before the latter decided the measure against him.
In a conversation today with citizens on Facebook, Berisha said that the judge is not free, but captured.
"The judge has no professional conscience. The judge is captured, she is not a free man. Of course she does not resign, she was asked to resign, she was given the opportunity. But she proved that she is a person who is caught up in her problems," said Berisha.
After the administration of the letter of the Assembly that announced on Thursday afternoon that Berisha no longer has immunity, SPAK submitted this Friday the request for the replacement of the security measure, from that of the obligation to appear, to that of house arrest.
Judge Irena Gjoka, challenged several times by Berisha's lawyers, invited both parties, SPAK and Berisha with their legal representatives, to appear in the Special Court at 10:00 on this date to make their submissions.
The Special Prosecutor's Office requests the toughening of the measure with the argument that former Prime Minister Sali Berisha did not repeatedly implement the security measure "Compulsion to appear" set in October by the same court.
But on the other hand, Berisha and his lawyers claim that an insurance measure resulting from an unconstitutional decision could not be implemented, as long as permission was not requested from the Assembly. This SPAK decision was also sent to the Constitutional Court, but it did not consider it.
SPAK is investigating Berisha with suspicions that he was involved in corruption in the privatization procedure of the former "Partizani" sports complex.
