
The Council of Mandates and Immunities has restarted the discussions regarding the request of SPAK, for the removal of immunity from the former prime minister, Sali Berisha.
Meanwhile, the only one from the opposition present in the Council of Mandates and Immunities, Enkelejd Alibeaj, in his speech at the end of the debates regarding the SPAK request, declared his vote in favor of the request.
He added that today's decision should be considered as a service to Albanians today and in the future. Alibeaj emphasized, among other things, that there should be no immunity for anyone and that this is a new standard that must be established.
“According to the procedure, this council must draw up the relevant relation. The Council is obliged to express its opinion, listening to the considerations of SPAK and lawyers.
As a representative of the opposition, it is easier for me to express my opinion and that of the DP regarding the SPAK request. I must make clear the burden and the great weight of decision-making in this council.
I am not confused between what I have this burden and this weight, I have a slightly more specific potion. With the deputy in question, I consider the position a little more specific and this is one side, on the other hand, as a representative of the DP, I will present what should be the position of the assembly.
We are not a court, but each one of us has a burden, not to determine guilt or innocence, but something else, a simple thing, what should be the moral and ethical political standard for the member of the Assembly to maintain whenever there is a request from side of the justice bodies for granting authorization.
DP has had it for a long time as a standard that whenever there have been requests for the removal of immunity, the political standard has been the giving of free will, the stripping of immunity. Today more than yesterday should be the only foundation stone against which we should not have fluctuations. We maintained this position in 2012, as well as in 2016 in the case of constitutional changes. We kept it in the case of the Tahiri case, this was the side of the opposition at that time and it voted for the requests for authorization, arrest, personal control and housing to be voted on, while for the other measures there is no need for a request. It was the majority that did not accept it as a political and ethical standard. We also asked him in the Blako case, even though he was told or forced, he made a move that left his immunity voluntarily.
The stance that DP has taken has been YES, whenever there is a request for granting immunity, we have been in favor. The relationship between politics and justice must be such, no obstacle in cases where justice requires it.
The DP has also submitted an amendment to the Parliament's regulation, so that when the deputies voluntarily take the oath, they give up their immunity and do not benefit.
It has been 30 years since the government in this country, if there has been a defect, it has been the abuse and protection against immunity. It has created institutional irresponsibility to the point of corruption. It is time now for this parliament to set it as a stone for the future as well.
The reform in justice, despite the technical changes, basically had this thing, the removal of any kind of political protection against justice. Whenever there is such a request, the matter must have this solution. Opening the way to justice.
If the issue of Berisha's immunity is being discussed today, another one is closely following Edi Rama. The standard that we set today for justice, as long as a position is maintained towards a former prime minister, should also be maintained towards the current prime minister.
Let the SPAK also decide to maintain the same standard, open the reports involving the prime minister and ask for the removal of immunity.
We can be deputies with different experiences, we must not forget that Albanians want a policy that is not equal to them before the law. Consider it as a service to Albanians today and in the future, zero immunity for anyone, total support for SPAK. Creating a positive condition that does not allow the perception that double standards are being created.
