The Mandates and Immunity Council met this afternoon to discuss SPAK's request for the arrest of former minister Arben Ahmetaj.
SPAK accuses him of being involved in the incinerators case and sent a request to the Assembly, in order to allow the arrest and personal search of Ahmetaj. The session started around 4:10 p.m. and the head of SPAK, Altin Dumani, also participated in the commission. Meanwhile, Ahmetaj is represented by his lawyers, deciding not to participate in the meeting.
His own lawyers have requested the postponement of today's session, as they want a day to prepare their defense. The meeting is being held behind closed doors. SPAK requested that the media not be present, as according to the prosecutors there are secret documents and they should not be released. But it seems that everything is formal, since the file ended up in the media yesterday. The names of the witnesses and collaborators of SPAK were revealed, as happened with all investigative files.
Ahmetj himself had no role in concession contracts, but SPAK claims that he influenced colleagues and other employees to sign the agreements.
SPAK has charged him with corruption, money laundering and concealment of wealth.
According to the Constitution, the Code of Criminal Procedure and the Regulations of the Assembly, the arrest of a deputy must first be discussed by the Assembly. The Mandates Council is the one that listens to both sides and drafts a report, which goes to the plenary session. Then this report is put to the vote and the moment the deputy's immunity is removed, SPAK opens the way to arrest him. But in the end it will be the court that will decide whether or not Arben Ahmetaj should remain in prison.
