December looks set to be a very busy month for the Constitutional Court. This court has had quite a few sensitive cases this year, but attention has recently returned to two interesting cases: “Veliaj” and “Balluku”.
Veliaj emerged victorious by canceling the article, while a hearing was held today regarding the government's appeal regarding the GJKKO measure against Deputy Prime Minister Balluku. The case was postponed to December 2, where a decision will be made whether or not to proceed to a plenary session to review this case.
But this is not the only issue, as there are a number of other cases that constitute public interest. On December 16, the Constitutional Court will decide on the ban on TikTok. It concerns a lawsuit filed by the “Association of Journalists of Albania” and the “Balkan Network for Investigative Journalism” center, with the subject: “ Abolition as incompatible with the Constitution of the Republic of Albania and the European Convention on Human Rights, decision no. 151, dated 06.03.2025, of the Council of Ministers 'On taking temporary measures to avoid the negative impacts of the TikTok online platform' ”.
The following day, the Constitutional Court will decide on the fate of Sali Berisha. The latter has appealed the security measure "compulsory appearance" and the court will decide whether there will be a change in this regard.
On the 23rd, the Constitutional Court convenes for former minister Ilir Beqaj, who also seeks freedom and the overturning of decisions of three other levels of the judiciary. Meanwhile, the scheduled hearing regarding a request by the Union of Judges for magistrates' salaries has been postponed to January.
Another interesting development is that today Mayor Veliaj also addressed the Constitutional Court, requesting his release from prison. However, there is still no date for when the case will be reviewed.
Also today, the Constitutional Court has decided that the issue of the decree of Minister "Diella" by the President of the Republic, Bajram Begaj, will be reviewed in a plenary session.
The Democratic Party requested the repeal of Article 2 of the Decree “On the Appointment of the Prime Minister”, No. 331, dated 12.09.2025, as incompatible with the Constitution of the Republic of Albania. Likewise, the DP requested the repeal of Article 1, point 1, second sentence, of the Decree “On the Appointment of the Council of Ministers”, No. 333, dated 15.09.2025, also as incompatible with the Constitution.
The Constitutional Court Panel decided to move the case for consideration in a plenary session based on the submitted documents. So, it seems that not only December, but also the beginning of 2026 will be busy for the court. /Pamphlet
