Today, the reasons for the decision on why the Court of Appeal in London upheld Sali Berisha's "non grata" declaration in Britain have been clarified.
The court has assessed that during the time of former prime minister Sali Berisha governed the country, there was a considerable level of corruption in Albania.
Also, it is argued that Berisha has influenced the investigations for Fazlliç, emphasizing that there was strong political pressure on the prosecutor's office from Sali Berisha and his government.

Reasons why the decision was taken to declare non grata:
(a) A significant level of corruption that occurred throughout Berisha's time as Prime Minister. Appendix B includes the following:
"Evidence of wider abuse of power as Prime Minister"
Internal reporting shows Berisha's abuse of power in the appointment of corrupt officials, interference in Albania's judicial system to protect subordinates from investigations and court proceedings, and illegal wiretapping of political opponents.
Widespread corruption by Berisha and his government, especially in the run-up to the 2013 elections
The internal reporting provides a consistent and clear picture of widespread corruption throughout the period of Berisha's government, but especially in the run-up to the 2013 elections. This was used to advance his interests, help his allies and buy political support.
Close political control of Berisha and the dominance of his government
Importantly, internal reporting shows that the massive and widespread corruption of his government could not have occurred without Berisha's knowledge and authorization given his personal control over his government.
The representations of Dr. Berisha, including specifically the steps he claimed to have taken to address corruption and the involvement of other politicians in corruption. This was deemed irrelevant, because even if it were true that others (such as his successor at the head of the Democratic Party, Lulzim Basha) were involved in corruption, this would not mean that Berisha was not involved.
(b) Intervention in the investigation for Fazlić:
(i) Open source reporting on Fazllic, who was Berisha's friend and election advisor and his daughter's legal client and was investigated in Albania for money laundering.
On the website Balkan Insight there were reports that the investigation was subject to "strong political pressure on the prosecutor's office from the government and Sali Berisha. A 2008 US State Department report reached the same conclusion.
(ii) Dr. Berisha në deklaratën e tij të parë dhe të dytë të dëshmitarit nuk trajtoi pretendimin se ai kishte ushtruar presion ndaj autoriteteve të ndjekjes, por pohoi se hetimi ndaj Fazlliçit nuk ka vërtetuar ndonjë keqbërje prej tij.

(c) Blerja nga Fazlic i tokës në kufi me parkun energjetik të Porto Romanos
(i) Raportimi me burim të hapur tregon se: vajza e Berishës, Argita Malltezi, u largua nga puna në OKB disa muaj pasi Sali Berisha u bë Kryeministër në 2005, për të hapur një zyrë ligjore në Tiranë; me ndihmën e bashkëshortit të saj. (d) Berisha ka përfituar nga lidhjet me kriminelët dhe aktivitetet kriminale:
(i) Ka raportime të brendshme që tregojnë lidhjet e Berishës me kriminalitetin dhe krimin e organizuar dhe gatishmërinë e tij për të inkurajuar mbështetësit politikë që të përfshihen në dhunë. Ekziston edhe një raportim me burim të hapur nga dhjetori 2021, i cili tregon pamjet të kriminelit të njohur shqiptar Fation Dauti duke shkelmuar dhunshëm derën e selisë së Partisë Demokratike në emër të Berishës.
Dauti është përjashtuar nga Britania e Madhe për shkak se vlerësohet se ka pasur rol drejtues në një grup të krimit të organizuar. SIAC ka zbuluar se Dauti është një anëtar me ndikim i një grupi me bazë në Mbretërinë e Bashkuar që importon dhe shpërndan drogë të klasit A në MB dhe se ai është përfshirë në dhunë ekstreme.
(ii) The CSNP team considered Berisha's statement that he did not know Dauti, but rejected it based on internal reporting and their evaluation of the video. The ministerial submission admitted that Dauti's proximity to Berisha in the video did not necessarily prove a personal relationship between the two. Reasons for the decision
The reasons for the decision of 27 February 2023 to uphold the decision of declaration non grata, notwithstanding the representations made on his behalf, can be found in a ministerial submission dated 21 February 2023, with annexes.
The following summary appears in Annex D: "It is noted that it has not been possible to sufficiently prove that Berisha has a personal relationship with Daut. However, open source media reports, internal reports, US State Department reports and further evidence described in Annex E have provided substantial and credible content, evidence implicating Berisha in serious and serious crime. and organized corruption.
