The Constitutional Court has given a strong blow today to the Rama-Meloni pact for refugees. Just as he warned, the Democratic Party referred you to the court for the pact, and the Constitutional Court decided to act within limits.

Its president appeared in a press conference, announcing that the request made by the Bardhi-Berisha group had been accepted for consideration, as it met all the criteria.

But the acceptance of the request brings into play Article 52 of the Law on the Constitutional Court, which forces the Assembly to block the ratification of agreements at the moment the court decides to examine them.  

" 1. The Constitutional Court examines the compatibility with the Constitution of international agreements before ratification.

2. The Constitutional Court is set in motion to review these issues only at the request of the entities provided for in Article 134, letters "a", "b", "c", and "ç", of the Constitution. The court can also be set in motion by the subjects provided for in the letters "d", "dh" "e", "ë" 'f" "g" "gj", "h" and "i" of the Constitution, for issues related to their interests.

3. In case the case has passed to the plenary session, the procedures for the ratification of the agreement are suspended. The review of the request is completed within three months from the date of its submission.

4. In the event that the Constitutional Court decides the incompatibility of the international agreement with the Constitution, it cannot be ratified ", it is stated in Article 52.

So it is point 3 that specifies everything. The pact is suspended and the next element is that the Court has 3 months to finish the examination. The Constitutional Court announced that the first session will be held on January 18 and has until February to decide. In the best case, if the review is closed on January 18 (it may happen that it is postponed or there is another session), the Constituent Assembly herself has 1 month to make the decision, which means that the pact is not implemented at least until February .

The plan of Rama and Meloni was that in June the infrastructure would be ready and the arrival of the refugees would begin, but this is most likely not going to happen. The Constitutional Court's decision postpones their arrival, always if in the end the court accepts the agreement, since if it is rejected, then only the photos of Rama and Melon will remain.

It is not the first time that the Constitutional Court examines agreements of such great importance. One of the most popular cases is the maritime pact with Greece, reached by the "Berisha" government. The Constitutional Court overthrew it by blocking the sale of sovereignty. / Pamphlet
