The Constitutional Court has rejected the request of the Democratic Party, which requested that the Assembly's decision not to send to this court the motion related to the incompatibility of the mandate of Socialist MP Vullnet Sinaj be declared incompatible with the Constitution.

According to the Constitutional Court, making a decision on Vullnet Sinaj's mandate is not valid 6 months before the end of the mandate.

The lawsuit signed by 14 DP deputies was filed with the Constitutional Court on March 5, just a few days before the deadline passed.

The Law on the Functioning of the Constitutional Court provides that "a request for incompatibility of the function of a deputy may be submitted to the Constitutional Court as long as the deputy's mandate continues, but no later than 6 months before the end of the mandate...".

The mandate of the current members of the Albanian Parliament ends in September, when the 140 new members who emerged from the parliamentary elections on May 11 are expected to be sworn in. As a result, the motion of incompatibility of the mandate for MP Sinaj could not be reviewed by the Constitutional Court after March 10.

Vullnet Sinaj was defended on January 30 by the Socialists in the Assembly, who voted against sending their colleague's mandate to the Constitutional Court for interpretation. In a half-empty hall, the majority overthrew him with 61 votes against and 12 abstentions, among which was that of the DP deputy, Bujar Leskaj.

The evidence presented in the motion was several purchase receipts from public institutions near the "Big Market" supermarket chain owned by Sinaj, totaling 3.6 million new lek (36 million old lek).

But in the meantime, the motion of incompatibility signed by opposition MPs was reviewed in the Council of Mandates and Rules on November 20 of last year, and for about 2 months, the Speaker of the Assembly, Elisa Spiropali, did not call another meeting of this council to continue the procedures.

So, Vullnet Sinaj escaped the mandate first of all by Elisa Spiropali's delay until sending it to the Assembly for a vote, but also by the delay of the head of the DP parliamentary group, Gazment Bardhi, who sent the lawsuit to the Constitutional Court just 5 days before the end of the constitutional deadline, raising a dubious role for him.

This is the second time that Gazment Bardhi has been suspected of "technically" saving the Socialists' mandates. The first time was with Olta Xhaçka.

More specifically, when he was part of the "Alibeaj" group, Bardhi sent a lawsuit to the Constitutional Court with only the signatures of 14 opposition MPs (1/10 of Parliament), part of the "Alibeaj" group, to restore the issue of Xhaçka's mandate in Parliament.

This lawsuit was accepted, but in this way, the Constitutional Court deprived itself of the right to review another request, drafted by 28 opposition MPs (1/5 of Parliament), attached to Sali Berisha, who requested the declaration of Olta Xhaçka's mandate as invalid, without receiving the "approval" of the Assembly.

For this "second" request, the Constitutional Court decided to suspend the trial, because the case had "already" returned to Parliament, and the story then continued with red cards being raised by Socialist MPs on the orders of Edi Rama to protect Olta Xhaçka.

But, even in the case of Vullnet Sinaj, Boldnews.al has previously reported that on the political level, the whole story turns out to be a futile battle of the opposition that dealt with Vullnet Sinaj's tricks, while the billions managed by Belinda Balluku's super-ministry are flying in the wind, both in infrastructure projects with costs many times higher than the most tired countries of the European Union, and in energy expenses, which are not seen either where they are used or where they are flying. / Bold News
