
Tirana Mayor Erion Veliaj today addressed the Special Appeal through his lawyers, appealing the First Instance decision that left him in "prison arrest".
According to the lawyers themselves, SPAK has no evidence to prove the corruption charge. According to them, the charge based on Article 260 of the Criminal Code is based entirely on assumptions. They are asking for a more lenient measure for the mayor.
Here are some of the defense arguments:
-It is presumed that Mr. Erion Veliaj has favored legal entities and their administrators who are being investigated under Article 245 of the Criminal Code, after having unjustly benefited from funds or public works from the Municipality of Tirana, but there is a total lack of proof of this alleged criminal fact, attributing this accusation to the level of allusions, insufficient even for the standard required in security measures, that of reasonable suspicion, which turns out to be unfounded in evidence;
-The suspects deny any element of illegality during their activity related to the Municipality of Tirana and in general the criminal offense provided for by Article 260 of the Criminal Code is not formed in any of its elements;
-The other fact attributed to Mr. Veliaj, the signing of several expenditure orders for artistic-cultural projects financed by the Municipality of Tirana, where the beneficiaries are several NGOs or limited liability companies that the prosecution presents as indirectly owned by Ms. Xoxa and her family members, also results in the same level of unprovability.
That for this field of activity of the Municipality of Tirana, cultural, artistic, youth and sports activities, from 2016 onwards, the Municipal Council as a representative body of the Municipality of Tirana, has decided to approve the establishment of an Artistic-Cultural Council, composed of 9 members who are prominent names in the artistic, cultural and sports life of the country. It is precisely this council that is the collegial body that decides on the approval of the specific project to be financed by the Municipality of Tirana.
