On the eve of the 18th anniversary of Kosovo's independence, the request of the Special Prosecution Office in The Hague for a 45-year prison sentence for each of the former KLA leaders has raised strong debates in Albanian territories.

For academic Artan Fuga, the current case in The Hague demonstrates a great paradox, where justice bodies, such as the Specialist Chambers, judge on behalf of Kosovo, but function completely disconnected from society and its interests.

Invited to the show "Të Pashoq" on the "Pamflet" YouTube channel, Fuga said that this situation creates a division between the legal act and the state and national context from which it originates. He emphasized that just as Ali Pasha's body remained in Ioannina while his head was sent to Istanbul, the state of Kosovo is presented with a problematic dualism; where the "body", i.e. the state and its institutions, is located in Kosovo, while the "head", which in this case symbolizes supreme justice, is located in The Hague.

-I have a request for comment. I also take the occasion of the 18th anniversary of Kosovo's independence. On what is happening today in The Hague with the former leaders of the KLA. The prosecution there gave a frightening claim, a full 45 years in prison for each of them. I would like a comment.

Artan Fuga : My comment is this, that this shows the great fragility that the state of Kosovo has today. Which means that there are justice bodies, such as this, this history of chambers, which judge on behalf of Kosovo. While they are completely disconnected from society and from interests. Despite the fact that justice must judge based on the law.

-Despite Kosovo, all logic?

Artan Fuga : Origin and fact for me are two separate things. So, in origin you can depend on something, so a cause comes, but this cause then becomes independent of the origin. And this happens. What does it mean? We see that the state of Kosovo is today, in this case, like the body and head of Ali Pasha Tepelena. The body in Ioannina, the head in Istanbul. So, the state is in Kosovo, the head is in The Hague. This is the problem outside of individual fate.
