While the Kosovo authorities present evidence every day that the vice president of the Serbian List, Millan Radoicic, was involved in the armed attack in Banjska, this party - the largest of the Serbs in Kosovo - has not declared.
This has not been a common practice until now, because when any of the Kosovar officials mentioned Radoicic in a negative context, Lista Serbe would show the defense of its vice president.
Regarding this question, Radio Free Europe (REL) could not get an answer from the official of this party. The chairman of the Serbian List, Goran Rakic, and his deputy, Igor Simic, do not answer the phone or text messages. The other officials of this party, from different municipalities with Serbian majority, were not accessible either.
In a statement for REL, Ognjen Gogič, a political scientist from Belgrade, estimates that the Serbian List has not declared this time, because "it has nothing to say" and that "I still don't know how to position myself towards it".
The Kosovo authorities named Millan Radoicic as the organizer and participant of the attack on the Kosovo police in the village of Banjské, on September 24. A group of armed and masked people killed the policeman Afrim Bunjaku and then the police killed three attackers of Serbian nationality.
However, Ehat Miftaraj from the Kosovo Institute for Justice, says that the Serbian List as a political party cannot bear the consequences of the actions of individuals, if it distances itself from them.
Political scientist Ognjen Gogič points out that Lista Serbe does not make decisions independently and that it is actually waiting for official Belgrade to first express its position on Radoicic's involvement in the attack in Banjska.
The Serbian List was founded in 2013 with the support of official Belgrade and the current president of Serbia, Aleksandar Vučić. Since then, with over 90 percent of support, she has won almost all local or parliamentary elections in Kosovo.
" When Belgrade decides how it will position itself against Milan (Radoicic), the Serbian List will also position itself and react in the same way. What distinguishes this situation from all others is that we have evidence, that is, a video has appeared, in which Millan Radoiçiçi is clearly seen at the gate of the monastery, in uniform," he emphasizes .
The Minister of Internal Affairs of Kosovo, Xhelal Sveçla, on September 26 published a video made by a drone with the claims that it shows the role of Radoicic in the armed conflict with the police in Banjska.
A day earlier, speaking about the large amount of weapons found, Sveçla also said that the police have found documents that prove the connection and direct participation of Radoicic in the action.
Gogic underlines that Lista Serbe and Belgrade can no longer deny that Millan Radoicic is not connected to paramilitary formations.
" He is known to the public as a politician and businessman, but we already have evidence that he is involved in illegal activities, which is the possession of weapons. Now, we've all seen him do things like that. Indeed, there is no way to defend something that is not defended, to deny his inclusion in a paramilitary formation ," Gogic told Radio Free Europe.
There is an arrest warrant for Millan Radoicic in Kosovo for "witness intimidation" in the "Brezovica" case, which has to do with illegal constructions and corruption. He is also suspected of being connected with the murder of the Serbian opposition politician, Oliver Ivanović.

Por, Ehat Miftaraj nga Instituti i Kosovës për Drejtësi, në një deklaratë për Radion Evropa e Lirë sqaron se “në bazë të standardeve të vendosura ndërkombëtare, një parti politike në tërësi nuk mund të mbajë përgjegjësi për sjelljen individuale të anëtarëve të saj, të cilën partia nuk e ka autorizuar të veprojë në emër të saj”.
“Bazuar në Kushtetutën dhe legjislacionin aktual, Kosova është një shoqëri demokratike që përcakton qartë se përgjegjësia penale është përgjegjësi individuale”, thotë Miftaraj.
Megjithatë, Miftaraj thekson se autoritetet e Kosovës kanë obligim ligjor që ta nxjerrin Radoiçiçin para drejtësisë për krimet për të cilat ai akuzohet, si dhe çdo anëtar të Listës Serbe në rast se kryen vepra penale.
“Megjithatë, ndalimi ose shpërbërja me detyrim e partive politike mund të justifikohet vetëm nëse partia mbron përdorimin e dhunës ose përdor dhunën si mjet politik për të shkatërruar rendin kushtetues demokratik, i cili cenon të drejtat dhe liritë e garantuara me kushtetutë”, saktëson ai.
Politologu Ognjen Gogiç nuk beson se Lista Serbe dhe Beogradi zyrtar do të distancohen nga Millan Radoiçiçi dhe thotë se një gjë të tillë tashmë e ka lënë të kuptohet edhe presidenti serb, Aleksandar Vuçiq.
Më 27 shtator, Vuçiqi tha se Radoiçiçi gjendet në Serbi dhe se do të merret në pyetje, por ai nuk u distancua konkretisht prej tij.
“Millan Radoiçiç nuk u fsheh asnjëherë, ai nuk kishte turp për rolin e tij... është tjetër gjë ajo që unë mendoj për diçka që ndodhi, e cila përfundimisht nuk ishte e mirë për Serbinë dhe nuk mund t’i sjellë Serbisë asgjë të mirë”, tha ai.
Gogiçi beson se Listës Serbe tani i duhet kohë për të “krijuar një strategji” se si të pozicionohet rreth kësaj çështjeje.
“Ata (nga Lista Serbe) mund të përpiqen të mbrohen, të gjejnë disa justifikime. Ndoshta do ta ‘lëshojnë në ujë tatëpjetë’, por për momentin nuk ka asnjë tregues se çfarë do të ndodhë”, thotë ai.
Që kur u zgjodh nënkryetar i Listës Serbe, në vitin 2018, kjo parti shpeshherë është dashur të “mbrojë” Millan Radoiçiçin, sepse autoritetet e Kosovës e kanë lidhur me vrasje, korrupsion, ndërtim barrikadash apo trazira në veri.
Lista Serbe në përgjithësi do ta përshkruante atë si një “hero” ose dikë që punon “për interes dhe mbrojtje” të serbëve në Kosovë.
Në një prej njoftimeve të shumta, Lista Serbe thekson se Prishtina zyrtare “nuk guxon të pranojë se sa autoritet ka Radoiçiçi në mesin e serbëve”.
“Kjo u pa më së miri të dielën, kur zoti Radoiçiq iu bashkua atyre në protesta (barrikada) dhe ishte me qytetarët dhe kryesinë e Listës Serbe gjatë gjithë kohës, për kënaqësinë e përgjithshme të të gjithë të pranishmëve, të cilët atëherë ndiheshin më të sigurt dhe të mbrojtur", it was said in an announcement, in June last year.
