Four national prosecutors are currently investigating Chiara Ferragni and charity workers Balocco following the huge fine from Antitrust. The risk for the entrepreneur is that of being accused of commercial fraud.
The crime of fraud in trade protects the fairness of commercial exchanges or, to be more specific, the buyer's belief that the product he is buying does not have an origin, quality or quantity different from that declared. Therefore, the crime consists in delivering to the buyer a commodity different from that which was offered to the public or agreed upon in an individual negotiation.
If they are not valuable items, the penalty is imprisonment of up to two years or a fine of up to 2065 euros.
Prosecutors will launch investigations to understand whether offering Balocco pandoro to the public constitutes commercial fraud. More precisely, it will be clarified what was the role of the influencer and the companies that manage her image in the choice to connect the sale of Ferragni brand sweets with a donation that apparently Balocco had already made himself.
