The European Court of Justice can rewrite the future of football.
The Court of Justice of the European Union has decided in favor of the Super League, which had appealed the monopoly from UEFA and FIFA. Furthermore, it is emphasized that "the organization of football competitions and the use of media rights constitute, however, economic activity. They must respect the rules of competition and free movement, even if the economic activity of sport is characterized by some specifics, such as such as the existence of associations with regulatory, controlling and sanctioning powers".
The court also underlines that, "in parallel with these powers, FIFA and UEFA themselves organize football competitions".
Of the original group of 12 clubs that launched the Super League in April 2021, only Real Madrid and Barcelona remained in the field (Juventus have started the process of leaving).
Backed by marketing agency A22, the case went to the "Mercantile" court in the Spanish capital, which in turn referred the case to the EU Court of Justice.
According to the ECJ, there is an abuse of dominant power by the two highest bodies of continental and world football, which exercise a monopoly.
The optimism of the previous day on the part of A22, the company that intends to develop the project for the new tournament, was confirmed by the decision of the Court of Justice of the European Union.
"The rules of FIFA and UEFA on the prior authorization of football competitions between clubs, such as the Superliga, violate Union law," the Court reiterated. Similarly, rules giving FIFA and UEFA exclusive control over the commercial exploitation of the rights associated with these competitions risk restricting competition, given the importance of these competitions to EU media, consumers and viewers. of.
